Important legal note: copyright transfers are only valid if in writing[*], so while it's pretty much a dick move, someone like Furie can say it's okay if you use his character and then turn around and sue you for it anyway. It would tend to defeat an argument of
willful infringement if you reasonably believed you had permission, but it would not defeat the infringement claim itself.

In any event, I don't think the case is going to be thrown out since that kind of informal permission can be revoked at any time. Issues of estoppel or laches might come into play if the use were particularly lengthy or the defendant would be subjected to extreme unfairness as a result of having relied on such permission.
