Wouldn't it be called into question if one of the investigators has been proven to have an axe to grind against Vic?

It's interesting to see the difference between what little support kickvic still has on Twitter and reality. Not just the massive lines that would bury this guy's tweets in a second just by posting 'waiting in line selfies', but this guy insisting 'I can't see the lawsuit so it doesn't exist' juxtaposed with Ty candidly informing Nick on the phone that "normally we say 'if you retract these, we may not sue'. We didn't say that this time. We are going to sue him."

It's also about most of their co-opters eventually retreating back to the bushes due to morale fatigue, i mean getting handed L after L after L has got to tax their fragile state of mind.

The whole investigation has to be looked at. If it's just people who were interviewed, that's not going to suffice. All they proved by that is that they were at the same place at the same time. Vic probably attested to that as well, and they used that to kick Vic out.

That's also why they didn't call him a fucking predator or anything; it was inconclusive. They thought, though, that the best choice was to kick him out either for business purposes or some of the voice actors threatened to leave or extort/blackmail them (tortious interference) if they didn't kick Vic out.

That summer 2018 investigation is key. I would like to know what happened there and what differentiates that one from the February 2019 one.
 
That might be a little :optimistic:. Nick is very much involved, and often makes statements directed at the defendants in a tortious interference case. All they have to convince the judge is that the deposition may lead to information relevant to their defense.

What's NOT :optimistic: is that Nick is a lawyer, and probably knows every possible out regarding a Texas court trying to depose a lawyer from Minnesota who's not named in the charges. I suspect he'd only go if he really wanted to. And he'd probably have the defense paying for his time and travel expenses if he did.

I don't see personal jurisdiction to force him to go anywhere or do anything. He's a non-party. Any information he has might not be attorney-client privileged since he's nobody's lawyer, but if he has done anything for Beard and communicated mainly with Beard, it's probably work-product.

There might be some stuff they could ask if they really felt like sending a legal team to Minnesota but it's hard to imagine a more wasteful squandering of money for absolutely nothing of use in their defense.

Senpai Isnt Home is currently streaming and has been talking to Emosh. Per Senpai talk + Emosh tweet. She entered with someone else's pass with others+her husband recording. She approached near Vic's table stating she felt uuuuunsafe. Con security was watching her the entire time and than kicked her out. Senpai states that Emosh does have the footage, and sounds like he's stating it will be released after the party tonight. So i guess keep your eyes out?

Big if true, imagine brigading to have other cosplayers banned to in turn get yourself banned, i imagine she had a camera man to go up to vic with her, film her talk shit and then post it as EPIC WIN, failed in the process.

Toye not being scared can be answered in two ways

A. He has some super secret evidence that he has on Vic and he is going release shortly

B. He's clueless as fuck

I think it's both. He THINKS he has super secret evidence but it's something fucking stupid like the tickle rape or glomping videos and Vic apologizing for any offense via text/email because he's clueless as fuck and doesn't realize normal people would laugh at him.

Nick isn't Defaming them. They would only be forced to prove Vic is a predator and Nick wouldn't have any reason being brought up in the court case. Assuming they do try and bring him up to bring into question Vic's credibility it would be quite unlikely that the judge would care as it doesn't pertain to Vic's case about defamation and Tortuous interference.

Nick would only be brought in if Monica was dropped from KC without her dropping it (same with the other ones) but considering that's not the case it's even more doubtful a judge would care.
Like I said, there's no charges against Nick here. But Nick IS involved: He's running the gofundme, he introduced Vic to Ty, and he acts as a mouthpiece for Vic's case and cause. He's substantially connected enough to warrant a deposition (remember: the court can't assume what he WILL say; only what he MIGHT say), but I would also assume there are logistical problems bringing him to Texas.

But point taken. It'd be pretty up-hill.

Vic will definately be deposed by the defense. But I wonder: who ELSE would/could the defense depose? Remember, they need to show evidence that Vic is a creepy deviant who preys on women and children.

Defending themselves at all would be a wasteful squandering of money. I'm laboring under the delusion they intend to mount some sort of defense. (Okay, my turn to be :optimistic:, I guess.) Though, in all likelihood, the lawyers will get together, look eachother in the eyes, and settle on some huge undisclosed sum. I REALLY hope Ty doesn't let them off without a very Very VERY public apology from EVERYONE INVOLVED. But that's just the nature of law: these things tend to fizzle out unceremoniously.

I do believe Jamie stated something along that line and obviously it would.
Ron also brought it up early on and made it seem like it was related to sexual conduct so it would stand to reason a subpoena would be issues for it.
So really even if they never stated someone with an ulterior motive was apart of it it would be brought up sooner or later and they'd be brought into this mess.
We are also forgetting that Monica? or Jamie stated nothing about con findings but only internal findings which under Law is illegal as an outside investigator needed to be hired.
