[4/13/19] Ty Beard Reveals 400 Page 20lb Takedown Order Against Ron Toye - Beard Bomb Has Been Planted

Double his tweet volume. There may be a brief respite following his next lawyer meeting. Simply because his lawyer is going to take his phone and smash it with a hammer. So it will take him a day or so to get a new one.

Ty hinted at a TRO filing. If so, that'll be the first thing he gets along with the suit. If he does any such thing he'll be back in court so fast his head will spin, first for something like $10K a day sanctions and next for jail.

Ron made things personal by filing that bar complaint, so I guess he sowed the wind and is reaping the whirlwind. That alone tells me he is not thinking properly about all this. I actually feel sort of bad for his lawyer. I mean, how do you defend this sack of shit? "Yes your honor, it's true he lied in am official legal document about our colleague; he lied online about the plaintiff, despite numerous people telling him to please for the love of God shut up; and he can't seem to retrain himself at all. But we should still consider these circumstance that mitigate his behavior."

In his Lawyers defense, you don't expect your clients to be quite as openly stupid as these fools. Look back at Nick's interview with the Amazon's. They were completely stunned at what they were seeing these millennial fools just keep pooring out onto social media, with no signs of stopping, even when told to stop. I mean when you have the opposing council's discovery team, there on camera giving an interview, outright stating that you were giving them more free discovery than they had ever seen before, anyone with half an ounce of common sense would have stopped. But that was weeks ago. And this moron just don't quit. "They can't sue me, they won't sue me! My peeps on t he interwebz tell me so!" and "Well if they sue me then Vic will regret it! He will be ruined!" Uh huh. I wonder if Ronnie has figured out that he has no actual path to counter sue Vic, as Vic has seemingly never publicly communicated with or about him? And any lawsuit by Monica runs into the problem of "so you went with him to his hotel room? He kissed you. You said stop. and No. He stopped. And you left. So why did you go to his Hotel room in the first place? Weren't you sending some mixed signals? He clearly stopped when you said stop."

They’re already archived anyway. ;)
Yeah, and that's actually the crucial detail.

The preservation of evidence / spoliation letter basically means "don't try to delete any evidence before I can get a copy... because if I find out you deleted something to keep me from getting it, I will wreck you".

The request for retraction, then, means "okay, now I've got a copy of this evidence, and you need to delete it" (or retract it, or publish a statement to clarify it so that the message is no longer defamatory).

THE BEARD STRIKES

I thought it was considered removing evidence if the tweets are deleted though?
It's not necessarily removing evadance but it's still a bad move to make considering when you're talking to the jury you can say 'There were also some deleted tweets we could not preserve.' and the jury would have to then make the assumption that what was deleted was the worst of the offending material.

The solution of course is to not be a brainlet and post 400 fucking tweets of defamation and libel but we're talking about Ms Soye here.

Upon this day, April the Fifteenth, 019.M3 , Primarch Tyberius Beard so declared exterminatus upon the entity known as Ron Soye. Justice of the Emperor was delivered by 20lbs of processed tree bearing the markings of his unholy words against him.

See the title of this thread. Ron's getting a takedown order. After all the evidence has been collected, the next step is to demand that he remove these defamatory statements.

A take down order is literally telling him to remove the statements

It's a retraction demand letter. Tex. Civ. Prac. & Rem. Code § 73.003 is the law requiring it. Often you'll send one of these before filing suit and offer an opportunity to avoid suit by retracting. Ty has indicated they're just sending this immediately before actually suing because it's required if you're asking for punitive damages. He can't avoid being sued at this point no matter what he does, and they'll seek punitive damages anyway.

It's just an opportunity to reduce the damages, maybe.

Just taking them down won't do shit. It's a demand to retract them.

Would that have to be 400 retractions or would he, theoretically, be able to do a blanket retraction?

So I know we joke about Soye being a cuck and all, but can we just take a moment to appreciate the fact that these people are about to be serviced by a large Texan man who’s name is actually Tyrone.

The meme is real, I’m so proud of this community.

Oh I have the utmost confidence that by the end of this Ron will end up in jail for contempt of court and will get his asshole serviced by a real Tyrone.

Depends on how badly he wants to get fucked I suppose.

I rather suspect Ty dropped into ultra-petty lawyer mode, so there's a retraction demand attached to each individual tweet.

So no, blanket statements won't suffice and he won't have fulfilled the request by the time the lawsuit is filed.

Can somebody please check Monica's purse and make sure Ron's balls are still okay? Because ouch.

The most obvious lie would be in his bar complaint where he claims that Vic ordered his followers to harass Vic kickers "by any means necessary" when Vic said absolutely nothing of the sort.

This was, quite simply, a brazen and deliberate lie in an official document submitted to a legal forum.

What would a competent lawyer charge to look over all these take down notices?

A decent lawyer is at least a couple of hundred an hour. Given the sheer amount involved they'd need a ton of time, or at least a couple of junior associates to get through it. Either way he's probably looking at at least a few grand conservatively.

The real question is, does he even have an actual lawyer? I can't imagine any lawyer representing him allowing him to continue spouting his drivel up until now, once he knew a suit was imminent. If he didn't have a lawyer before this, he's gonna have a hell of a time getting a good one now.
