Wait a minute does this mean Vic's backing down?

Holy shit, are they...are they refusing a deposition? Are they actually trying to not get grilled at all!?

Pretty much.

Read both PDFs, language in the same in plain English is:

"We don't want to do this, we want it to go away, and we want Vic to shut up and accept what he's been smeared with. Further, we had a message sent to his lawyer to make this go away and he replied he got the message, which we took as a yes, not confirmation the message was received. Now please make Vic accept his social degradation like a good boy already."

Assuming they are being truthful...

Okay, I'll wait for you to stop laughing.

...they're saying that they didn't get the two weeks they should have. Also, that Beard had contacted them and withdrawn the subpoena.

There's a couple problems here. First, you don't need a court to quash a subpoena that's withdrawn anyways. Even I know that much.

Two, they include the original subpoena but not the withdrawal statement? Huh?

I think this has more to do with Beard adding more documents to the request (like the ones involving conspiracy involving Beard, Vic's girlfriend, etc.) and agreeing to allow them not to bring those documents to the deposition. Not 100% on that though.

@Capsaicin Addict

The withdrawal thing is included in the Certificate of Conference. Ty withdrew the document requests but not the actual notice of deposition.
Ahh, I'd missed that.

This is pretty amusing, though. Asking for a protective order from court filings? My, someone got two scoops of chutzpah in their Fruit Loops that morning.

It says elsewhere that Ty Beard "stipulated" that the Subpoena Duces Tecum and discovery requests were "inadvertently included" in the Notice of Deposition, which I assume is lawyer-speak for "Ty knew that they could challenge it but figured it was worth a shot anyway". He's running a full-court press and they're trying to stall. I'd assume that BHBH probably anticipated this tactic and would be prepared for it. They actually object to every request for discovery with the exact same canned statement, so it looks like they're just trying to force BHBH to justify the requests, which if nothing else will give them extra time to respond.

Can anybody who knows more about the process perhaps explain whether this could also mean that they'd get extra time to respond to the discovery requests in Vic's Original Petition, or that they might not have to answer them? It looks like they're just objecting to the discovery requests in the Notice of Deposition, so would the discovery requests in the Original Petition be unaffected by this motion?

Hopefully Nick can explain this in detail because it's really getting into the nitty gritty of the civil process.

Assuming my summarising skills are correct the short version is:
  1. Ty had sent a deposition request with extra discovery requests attached.
  2. Casey emailed Ty saying "Really now"
  3. Ty responded saying the extra discovery requests were an "inadvertent inclusion" BUT the deposition request stands
  4. Casey has filed a petition saying:
a) This discovery is excessive
b) Being deposed at BHBH would be unpleasant
c) Court, please protect my clients from the nasty Ty by blocking this

I'm not a lawyer and have no clue how a court will treat such a petition.

Pretty much called it earlier. This is their "we are being treated unfairly, my lawyers need more time to review all this crap, and no we are not going to cooperate with the plaintiffs unless the court makes us" motion.

Its a delaying tactic to string things along. Now Ty is going to have to craft a response to their motion to quash, and then the judge is going to have to spend time telling Soye and Rial to cooperate, and then we will get to the phase where they actually respond to the lawsuit.

Pretty much confirms Rial and Soye are going down the dark path of trying to fight this out. Considering its going to burn through their money long before Vic runs out of GoFundMe cash, its a self defeating move IMO. Smarter path would be to either settle or try and get this moving as quickly as possible. But they want to try and bleed Vic dry instead. Its a bold plan cotton, we'll see how it works out for them.

Honestly I'd say this proves theyre stuck in Twitter la la land and/or relying on typical SJW theatrics. Calling it now when the judge says "lol nope deposition nao faggots" there's gonna be whining online and possibly attempts at whining to media about soggy knees
