I was under the impression he was suing for TI with prospective business relations (or similar, not TI with contract) specifically because it seems much easier to prove how they've affected his prospective business relations. Proving interference with a specific contract would be difficult, but not impossible (especially after the whole Kamehacon ousting).

If their lawyer pulled a Shane, he's gonna be the fucking "chair lawyer" from here on out.

Doubt it. She'll double down after this. Give her time. These types live in a perpetual hugbox. Vic and BHBH forcing the door open and tossing sand in the hugbox is going to drive her absolutely bugfuck nuts once she has time to calm down, get emotionally validated by her cunty mean-girl friends on twitter and IRL, and she'll decide that it was all the fault of the patriarchy for daring to even give Vic a chance to speak to a lawyer in the first place.
I highly doubt that myself considering how desperately she's trying to avoid even being served. That says to me she isn't delusional like MoRonica she knows how badly she's fucked if Ty gets a hold of her. After the Amazons get through with her and Vic cleans out her bank account assuming Funimation doesn't get carved up like a Christmas turkey by an angry Sony and Marchi is able to salvage her career somehow I highly doubt she'll be eager to throw out sexual assault accusations like they're candy anymore.

Hell I wouldn't be surprised if she nukes her social media entirely because you just know she'll be trolled endlessly for this.
 
Half of their defense is that the statements were exaggerated fairy tales!?! Are we sure we aren't living in another timeline? Months, MONTHS, these people have been screaming; "It's all true! All of it! Every last detail! We can't wait to prove it!" Only for us to be hit with a filing that outright states it's not only not all true, but that PEOPLE SHOULD HAVE KNOWN BETTER THAN TO BELIEVE THEM.

I may be all wrong here, but having just read thru the affirmative defense , it appears that Casey is throwing everything at the wall and hoping something sticks. The statements were true. The statements were hyperbole. Statute of Limitations are up. My clients are so dumb anything they say is not to be read literally. I did find it interesting that MoRonica requested a jury trial. I guess they like their chances better with 12 conservatives as opposed to one?

Yes. Casey is just dealing with the hand he's been dealt. In his defense, having contradicting statements in your filings is perfectly acceptable. The statements don't inherently invalidate one another (although it obviously gives Ty ammunition in his response) and the court is happy to accept any argument a lawyer makes even when it contradicts a separate statement.

This is pretty much what happened. He's attempting several legal defenses in order to mitigate any damages that will come from an inevitable judgment against his clients. He even says that the 90-day statute of limitations on being served concerning defamatory statements had run out, even though according to my calendar, only 84 days had passed. It's not much of a defense, it's just to answer the complaint. We'll see how it plays out on the 31st.
