That is as close to admitting that a TCPA motion is going to fail and that the case is going to go to trial that they could make. Of course, they don't know that.
The TI case is so absurdly solid that it is the kind of case lawyers dream of. You never see the facts line up almost as if by magic along the exact contours of the doctrine that defines the tort you're suing over. You could literally teach this as a textbook example of the tort.

This is surprisingly eerie considering I compared Vic's lawsuit to the Battle of Gettysburg way earlier in the thread.
The weirder part is that the original Lost Cause mythos didn't develop until after the Confederacy was decisively defeated.
Makes you wonder how many of the KickVic crowd secretly know their movement's likely fucked beyond all hope but are too afraid to openly admit it.....
