The sixth amendment, in the first four words of the amendment, says "IN ALL CRIMINAL PROSECUTIONS".

This isn't a fucking criminal case.

The argument is that punitive damages are essentially criminal in nature and therefore should be treated as such. There is no rule or binding precedent in Texas that supports this claim, and in fact, Texas's civil rules quite clearly require punitive damages be proven to a clear and convincing evidence standard, not beyond a reasonable doubt.

It doesn't seem like a very good argument, though.

It's one that's been made in some law review articles, but not successfully in any court, or at least not any court in Texas or in the Supreme Court of the United States.

We were discussing this earlier in the LOLSUIT thread. It is probably a personal crusade of the lawyer. He's putting this in there in the hopes that the case offers him a path up through the Federal Courts to charge at his personal Windmill. It probably means nothing to this case.
 
lol Ty, while you're negotiating settlements with Jamie, remember everytime she:
  1. Made a defamatory tweet
  2. Hoped for some kid had been diddled by Vic so she would have a stronger case against him
  3. Interfered with his con appearances
  4. Dodged service
  5. Made smug tweets about dodging service
 
Stuff can come out in discovery, but so far we don't have evidence of her tortoisely interfering, right? Nick even said she was not involved in the KamehaCon texts.
How many con appearances did Vic lose?
Jamie could have had a part in any one of the other ones.
We'll find out soon enough.

I have no reason to believe she hasn't done it. Just hasn't been discovered yet, if I'm wrong whatever still quite a laundry list without it.

It was around a dozen.

It's possible something which implicates Jamie will come out in Monica and Ron's depositions, too. They don't get to just tell "the full story" about Vic.

Apart from tilting at windmills, could it just be for padding? It's 1/2 a page of a 3 (2 and a bit) page response...

EDIT: Superchat just mentioned that there's at least one other filing by Marchi's lawyer with the punitive damages are unconstitutional arguement.

He didn't get reinvited to KawaiiCon, he got a new invite to a separate event called HawaiiCon.

Thanks, i knew there was a Hawaii convention that Vic was invited to and Nick was planning on going, but had no idea of the convention name. I just guessed it was Kawaii as it was in Hawaii, although i should have looked at the date and realised that wasn't possible.

That doesn't mean that she didn't call, email, or contact them (or some other convention or relevant party) in some other manner. As others have pointed out, she wouldn't be acting the way she is if she didn't have something she'd rather prefer didn't come out. There's enough Tweets or other archived conversations here to suggest that there's more out there.

I think the real reason she's in round one is that BHBH knows she won't be able to put up much of a defense and can probably yield information against other potential targets that would be added in subsequent rounds of litigation. Also, being able to force an early settlement where she makes a public statement about the allegations being nothing more than gossip goes a long way towards helping Vic's reputation.
 
That will be the one thing I will find absolutely hysterical when we get to see the depos is how many times will the (un)happy couple(?) try to derail every question they're asked.
The more they play stupid games instead of just answering a question the more they're helping pad Caseys bill.
