Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

There's always that worry, but the first deposition is the following day which would give them a single evening to study the material (assuming any video or transcript is immediately available to them) and just wading through it all, never mind crafting strategy around it, would consume about as much time as they have.

Then, even if they do try to come up with a strategy, they can only play as loose with the truth as they assume that BHBH won't be able to immediately call them on it. Trying to dance around a particular point does you no good if the other side has some other piece of evidence that nails you down.

Any time that Casey does spend with these clowns would be better spent getting them to behave or not to say anything stupid that will tank the case. It's like training a puppy. You don't spending time teaching it to do backflips if you're still worried it's going to shit all over the carpet.
It's like trying to cram last minute for a test the night before when you have basically fucked around the entire time. Inefficient and it never works. Texas depos iirc have limited way of objection, so when BHBH asks them about all their bullshit, Casey isn't going to be able to do much. We all saw what happened to Waid, now imagine that multiplied.

They can't really craft their way around having repeatedly contradicted themselves and flat out admissions of wrongdoing. They can't craft their way into having hundreds of rape victims to produce to prove the dumb shit they've repeatedly said. Even if they can, 24 hours isn't much to do anything with any of this stuff.

I believe the subject of Vic's deposition will all rumormill/gossip bulls#!%. Expect to her about vic's love life in that discussion. Ron is confident there are skeletons and I think I understand what they are. Relationship failures, bad exs and cheating accusations. Those two schmucks are going to dig up something dirty and personal. Most likely wont be relevant to the case, but it will humiliate Vic for sure.

I feel bad for Vic, but as a silver lining the deposition after will be juicy.

Both Ty Beard and Casey Erick have both "respectfully request that this Court extend the time to file a motion to dismiss" aka extended the time to file the TCPA. Also, Casey Erick filed a Notice of Change of Address (due to him changing firms).

Shane originally bragged he was getting promoted to partner somewhere else, but his title remains the same. i believe the new law firm is significantly less prestigious than his previous firm, tho still a ways away from "strip mall" lawyering.

There's zero reason to think it's anything negative. It's more likely a move which offers him more opportunity for advancement, more money, or both.

One thing which is interesting about the agreed new date of 19 July is that it's after Funimation's documents and responses to interrogatories are due (3 July). It may even be after Marchi's are due, too.

Drawing parallels with the Oberlin case here. Haven't read the case only recent postings so I could be wrong.

In Oberlin's it appears most of the damages done were through defamation and protests potentially blockading customers. Gibson's was a small, single store, family owned bakery where defamation was mostly localized. This is not the case for Vic. Vic has to travel for most of his income, multiple locations all at the mercy of whether they lie in a deep network of extreme political ideologists, which decided to make Vic some sort of hate target very publicly, which we have no idea how far extends. Vic certainly earns more than Gibson's (I mean look at those lines!)

What I'm getting at is Vic's damages are greater than Gibson's. So as a layperson looking in -ideally- his payout should be greater than $44m if he had the same lovely jury.

The jury awarded Gibson's something like seven or eight times what they actually asked for. They did this because Oberlin, a powerful institution catering to the affluent, attempted to snuff a small business out of existence because its students were throwing a temper tantrum over a lie. There's no powerful institution involved in the Vic Mignogna lawsuit. Funimation is the biggest player, and it doesn't dominate the economic life of its local community the way Oberlin does.

They might not dominate the economic life of it's local community, but you could probably make a strong case that it dominates the economic life of say, the anime voice acting community.

It's a pretty good argument. They've cornered the market on simuldubs (having episodes localized not long after the original airs, sometimes even on the same day) and they do a lot of distributing. They might even do the physical distribution for places like CrunchyRoll that only handle the dubbing and streaming

And Sony -- Aniplex -- recently bought them, which reduced the effective number of competitors.

Funimation is an entertainment company that Sony bought for about $140 million. It's a pretty good sized company, but the difference in scale is really important. It's unrealistic to imagine a jury awarding Mignogna a third of the company's value.

They're also different jurisdictions and Ohio culture is pretty different from Texas culture. The oberlin jury granted that massive award knowing it could potentially damage the entire local economy to send a message; a jury in this case would not give a shit about funimation so if they wanted to send a message, i don't think they'd hold back.
 
Also keep in mind Monica and Ron can be played against each other. If one of them says something thats inconsistent with the other then theres a problem. But that probably is less likely to happen since they will be able to talk to each other after thier first deposition

Monica and Ron both went to pieces because of people tweeting at them. What's going to happen when they are being asked the same line of questioning in a confrontational manner without the luxury of ignoring, blocking or deflecting? Maybe BHBH will allow them to bring a teddy bear for emotional support.
 
Interesting points and insights all around. I do think a judgement the size of Oberlin's is a bit :optimistic: since at this point Funimation's lawyers have been cooperative with BHBH. If they change tune and decide to fight tooth and nail for their unruly employees as did Oberlin on behalf of their student's lies I could honestly see it. These people are completely unlikable and wear malice proudly on their faces. One of the big reasons Oberlin's verdict was so huge was because they pissed off the jury. Gawker got smashed because the judge had a bone to pick. Get the likes of MoRon acting as agents of Funi with all their discovery shenanigans and I don't think the court would be too happy.

Thankfully for Vic, Funi is actually acting reasonable and want nothing to do with MoRon. There's still a chance for settlement and restoring his reputation in some ways. Which is ultimately what he wants.
