For people who spend all day circle jerking about this on twitter aren't they completely off base here? It seems like the TCPA that was referenced by Nick was only ever in regards to Monica and Ron to prevent them from slagging Vic even more. I can't recall hearing any reference to Marchi or Funi in regards to them and a TCPA filing mostly because they haven't been up to too much lately or had any filings going on.

You know what's not on that list? Funi's investigation.

I don't think that they're "citing" those articles as some kind of accurate source so much as using them to demonstrate that Vic's behaviour was already being publicly discussed and that their own tweet after they fired him wasn't defamatory if it's considered in that context.

Obviously we'll know more when the complete filing is available.

This is what Nick was mentioning about Law Twitter not caring about the "facts", they just want to "dunk" on laypeople.

It's bait for any ISWV spergers to go at them on twitter, and then for law twitter to flex on - nothing more.
 
Perhaps they're going with the old "well if you have to deny it" defense. That's about all I can think of, unless— they didn't happen to hire a super lawyer by chance did they?

Now I'm not even remotely close to a lawyer (I just have a bit of a passion for studying it), so take this just as layperson opinion:

I am close to betting that this move by Funi is closer to a game of legal-footsies with the other defendants. I'm thinking that Funimation is doing this to put space between them and put more of the burden on Toye and Monica.

And RoNica better hope that Funi's TCPA is upheld, because if it's quashed, I would be very comfortable putting money down that Funimation will immediately talk settlement, leaving fresh tire-marks on Toye and Monica in the process

The only possible reason I can think of them to include it is in reference to their affirmative defenses 3, 4, 5. "Vic talked about it first so it's not our fault if we talked about it too."
