He's not registered the copyright and the alleged infringement has occurred, so either Akiva is incompetent as an IP attorney or was outright lying about his intent to get statutory damages. Without that, he has to show the alleged infringement caused him financial damages, either through direct damage or loss of profit.

Seems like fairly common sense even for non lawyers. If I could go around filing copyright on things post-mortem to sue for 150k per incident everyone would be under constant lawsuits for them sweet sweet shekels. Him and his friend are just blowing hot air because they're used to the average joe running away with his tail between his legs.
 
I wonder how much transformation of the original work would be necessary to get around any copyright. I mean if someone were to photoshop all of the children into klan robes and show them burning crosses would it be sufficient to defeat any copyright claims?

Additionally even if Null were to take down those photos, what would stop someone else from finding photos taken by another person and uploading those instead?

BUT, always check out the little info boxes on the main page cause I know if Null took the time to put something there, it had to be good. I was nicely surprised and glad he did it for this thread! I probably never would have seen it otherwise.

It is always so great to see a thread about someone who actually went to law school, obtained his degree and works for a law firm, show what a huge idiot and jackass he is in reality. Working in the legal profession, it amazes me how someone with a law degree can be so stupid to make the posts that he did.
