I am not a lawyer and its obvious even to me what a stupid idiot the douche is. This is pre trial. Meaning "before trial". This where all the parties get their ducks in a row. Determine just what the actual dispute is, determine that the dispute is in fact something that violates law, and then arrange a presentation for the actual trial where the matter will be deliberated and decided.

What these morons are trying to argue are facts of dispute to be determined "AT TRIAL". But this is not trial. All the plaintiff needs to prove is there is a valid dispute. Which in this case is ridiculously easy. Ty does not need to prove Vic was defamed right now. He needs to prove that there is a valid claim he was defamed.

Law Twitter really is laughably bad at presenting any coherent legal arguments. I won't pretend like I know the outcome of a case this early on, but they don't even try to actually provide legal reasoning for half the shit they say. They instead rely upon legalese and just sheer overwhelming quantity of mentions/like brigades to prove their point for them.

Legitimately I quoted to them a Texas Supreme court ruling, and legal analysis, that went over how Truth is not an absolute defense to defamation in Texas, and all they could do was regurgate back "Truth is an absolute defense, period." Despite the opposite being provided to them with precedence from the highest court in Texas. There are multiple cases establishing this.

Texas looks at the overall gist of the statement(s) not the individual truth or falsity of each claim.

They also do nothing more than semantic quips, and then outright lie when cornered because they can't even get their language usage right. They are jokes through and through, and the only people who still buy into them are the traveling circle jerk for KickVic and drive by SJW types.

They are, in fact, trying to argue that privilege applies in this case as a way of explaining why Ron knew about the Funi investigation without being Funi's agent.

There are a number of problems with that argument which go beyond how common law marriage is codified in Texas, not the least of which is that spousal privilege (or its equivalent) is limited to communications which were intended only for the spouse. Ron making his knowledge of the Funi investigation public may well have negated any argument for privilege.

Now, IANAL, but I know a thing or two about privileged information. May does not -begin- to cover what Ron making that information public opens up for Pandora's box. The core concept of spousal privilege (And any other form of informational privilege) is that something about the situation (Being married, being in a position of authority, etc.) provides you a level of access to information that revealing said information in court would infringe upon.
I.E. If the court were to force a lawyer to discuss what a husband says to a wife, it would inherently rip apart the social fabric that makes up the family bond, and this could be abused really badly.
BUT, once you reveal that information publicly (And try to claim it falls under that), you just null and voided that privilege ENTIRELY. This doesn't just make a statement open to cross examination, it opens up everything they'd try to file under that privilege.
