It's about the TCPA in federal diversity cases in the 5th Circuit, and Meyer v. Waid is indeed a federal diversity case in the 5th Circuit involving the TCPA.

Holy shit:

"Resolving an issue that has brewed for several years in this circuit, we conclude that the TCPA does not apply to diversity cases in federal court and therefore REVERSE and REMAND for further proceedings."

Things just got very, very bad for Mark Waid.

This is such delicious payback for Waid's dilatory bullshit and evasion. My wild ass guess is this decision will have what is known as "pipeline retroactivity" and will apply to all cases in the pipeline at the time the 5th Circuit made its decision.

My prediction for Waid's next move after the jurisdictional wrangling was out of the way was that he'd file a TCPA motion.
And now it looks like that avenue will be closed to him. :story::story:
