But that is not for tomorrow.

Tomorrow Vic needs to demonstrate that there is at least a minimal amount of evidence judged in his favor of non-protected speech consisting of defamation and tortious interference by the defendants to defeat the TCPA motions.

Any of the local lawyers please correct me but tomorrow's hearing is based upon:

* The TCPA exists to give defendants an early out to protect against using the courts to stop them from exercising their constitutional right to free speech
* Defamation and tortious interference are not protected speech
* To get past the TCPA the plaintiff needs to show that there is a minimal amount of evidence for the speech in question is non-protected
* The evidence presented is judged most favorably towards the plaintiff
* It doesn't matter how much evidence there is or how good it is at this point. Just that it may demonstrated to exist.
* That evidence may be complete crap and lead to the defendants ultimately winning the trial but that is not relevant tomorrow.

Combine the two, and it sounds like the "Nadonly was hacked!!!11" was a desperate hail mary from KV to confuse people while they attempt to browbeat her into silence.

Sheesh. It was embarrassing to read that level of sloppiness.

Anyway, who is leaking these Monica DMs? It appears to be some kind of a VA or someone sympathetic to Monica, given that she's so willing to talk to them like a friend, but then they've gone and leaked it Supergirl style. Does anyone know? Is it posted in another thread and I just haven't seen it because I can't be bothered to stay on top of 50 WW threads?
