Generally speaking, you should always prepare for a loss because, even if it seems like everything is going your way, you don't really know how the judge will interpret things once it's before him. That's also why the justice system has an appeals system.

It seems like the judge is acting like a fact-finder, in contravention of the scope and intent of TCPA. One of the lawyers on Nick's Discord says that getting a successful appeal of evidentiary issues is very low, and he's right. That being said, if it can be shown the judge err'd on his decision of Vic being a LPPF then everything comes back, and it's likely then the TCPA is redone for all defendants.

Also, apparently Ron is out on TI because Ty couldn't show that Ron contacted other conventions despite saying they were going to, and the affidavits are not being considered at the moment.
