You can't remedy evidentiary defects on appeal. Nobody's said the actual declarations were struck or that the judge even cared about the notary issues.

Nobody's said they weren't either.

If they're in evidence, they're evidence and the judge is not at liberty to disregard prima facie evidence.

The standard on appeal is de novo which means the factual findings of the judge are entitled to no deference.

So what you're saying is that the mess-up on the affidavits can't be fixed and that the claims were thrown out despite all the stuff being in evidence already?

You only have people who want to see what you can do for them, while they do as little as possible for you. The only friends you have are those you had before any of your success.
