Nick needs Ty on the show ASAP to explain how the TI claims completely fell through.
In all honesty, I'd rather Ty not appear on the shows just to have 100% focus on work. If this is the result of how things have been so far, then he needs to be putting forth more effort instead of hopping on the show.
 
Did Ty actually seem to be fumbling before the Judge?

My opinion: overall, yes. Initially yes, particularly with Mrs. Marchi's Motion to Dismiss in isolation. Over time, he was able to get into a better stride. He was much stronger responding to the TI claim against Mr. Toye and the defamation claim against Funimation, as examples.

In particular, Mr. Beard appeared to do best when making oral arguments in the general (for example, responding without interruption to Ms. Rial and Mr. Toye's Motion to Dismiss). He struggled with clear and direct questions by the Honorable Judge Chupp. For the latter, I would state that Mr. Beard would:
  • Respond on point for a while, then try to get in related or tangential points
  • Try and argue a larger set of points together with a specific train of thought
  • Repeat prior arguments
Mr. Beard had a nervous tic, a specific nervous laugh, that came off as a bit dismissive. This occurred on a rather frequent basis.

Was the judge covering his face and getting exasperated with counsel?

I won't post the Picard face-palm meme, but I definitely thought about it during the trial hearing.

My impression was that Hon. J. Chupp started out very no-nonsense, and did his best to hide his exasperation. It was pretty clear during a recess for ... I suspect the 9:30 am parties showed up. Those three persons approached the bench for a quiet chat with the judge, and the audience chatted while they were up there for about ten minutes ... Listening to the chatter, the audience clearly sensed exasperation.

I have a relative who's going through family court right now. Their spouse was physically and psychologically abusive toward their children, and even with video evidence (using the camera the abuser installed, ironically), the judge is still considering awarding them visitation rights. It's bullshit like this that, whenever I vote and there are judges on the ballot, I always vote that they should not be retained. I don't give a fuck what party they identify as either - no votes completely down the line. It never usually matters, but it makes me feel better.
Family court is the worst cesspit of humanity's lowest dregs.

They are not just unpopular they are utterly retarded. Do you have any idea of how the real world works? Do you seriously think some judge is going to have his reputation and destroyed because he gets overuled in some stupid defamation case between prissy voice actors for children's cartoons? Because from the outside, ie to every single one of his peers, that's exactly what this case is.
 
Re: Getting affidavits from conventions, Ty attempted to argue that it was impossible for him to get statements/evidence from them because they weren't "friendly" and it was ultimately an excuse that failed to persuade the Judge.

Frankly, it doesn't persuade me very well either. It's not a question of asking, it's a question of subpoenaing

I have to say, I did fear for Vic slightly when Ty was on stream saying "oh we'll file as close to the deadline of midnight as possible" fucking hell man, let the evidence and strength of your filing be an inconvenience to your opponent, not the time you file it.

Marchi getting away was a given, but appeals are a thing and if Ty learned his lesson, then can probably get her back in on appeals easily.

Sure there were some rough decisions made today, but come on all isn't lost and there's still work to be done.

I do live in the real world and i've never heard of a judge actually saying 'legal definitions don't matter' with a serious face. If I heard about that, I'd laugh and joke the judge had brain surgery and had to do his job anyway right after.

@herexcell does seem level-headed when it comes to the court hearings. As I read it, I did side with the judge on this assertion. I'm now disappointed in Ty for not actually providing more for the TI. Though, I thought the phone call and text messages were enough. Guess I was wrong.

You shouldn't need to show actual numbers for this. The evidence should only need to be clear and specific, like a claim by Chris Slatosch that the contract was breeched, and Vic was forced to pay money out of pocket for extra security, etc. That is clear, it is specific, and it is even evidence.

I can imagine he was probably having a difficult time. The judge threw out his latest amended petition and only let him use his first amended petition (from what I understand) If that's wrong I'll delete this shit.

But I think that clearly hampered his case, especially regarding the TI cause. Slatosch's unsworn testimony was unavailable, and Chupp wanted specific numbers regarding the contracts (which seems like an issue to me, but what do I know?)

Regardless, it's not over yet.

Okay that answers that and if that's true, yes, Ty fucked up bigtime. If that's true. I'd want some more confirmation on that.
 
If Chuppy boy went ahead and dismissed the whole case today, it would almost be automatic reversible error and judges (especially ones like Chuppy boy) hate it when their opinions get reversed by higher courts. Because in their eyes, that is the higher court telling THEM they fucked up.

This is also something I've been wondering about. Not dismissing everything at once might've been more of a tactical decision, not that he needs time to decide - he already made up his mind.
Which would really suck.
 
Just from where I'm standing the issue isn't Twitter, but rather that you sullied yourself by being on it in the first place. Nigga that's like shouting about having poop on your shoe, when you gladly allowed a bunch of Indians onto your street.

I also stepped in it myself by rage tweeting at KickVic supporters. I just couldn’t stand their fucking smug ass tweets, so I rage tweeted in response. I’m a fool for doing so.
