When I said people on both sides were being exceptional and that it was turning into gamergate 3.0 I really made some people butthurt, well, 48 hours later :story:.

I'll restate what I said: every "public figure" and lawyer youtubers are exceptional, don't blindly take their arguments for gospel.
A lawsuit never goes the way you want, and as much as you despise the opposing party and its counsel (even if they act rarted), there can be merit to their arguments, and dismissing them purely for partisan reason is a luxury an audience can afford, but that no lawyer should. You do the best with what you're dealt with, formulate your best argument, and then the judge accept it of throw it away, even if he's wrong, in which case there's still the possibility to appeal.

Some of you people seem to don't grasp any of it, after embarrassingly praising Ty Beard with almost homosexual tones, some of you are now going the other way. It's ridiculous.

Now, there are still some causes left on the table, it can go the other way on the next round. Or all of this can be appealed. I'm just gonna sit back and enjoy the long protracted shitshow of both sides being exceptional.
The problem is that a lot of people were supporting this movement for a long time and are following these events very closely.

I unfortunately also fit that bill but after a while passed to let the news sink in, I feel as though Vic at least got room to fight back instead of laying there to take it.

Though for me, Weeb Wars, like gamergate and Comicsgate, could have been an opportunity to support indies and third party people so Funimation and sony won't get a dime out of customers.

It seems as though people would rather spend more of their energy sperging out than going on a goddamn search engine and look for "anime importers that are not funimation" instead.

The judge was "not impressed" with the Fuher's powerpoint.
Even Rackets thinks Ty botched it, he's basically dead last because no one was going to be worse than a man who brought a slide with nothing but an image of a burning dumpster to a legal hearing that could play a factor in bankrupting his clients.

After having read through todays events, I really don't know what to make of it. I can accept Ty made some mistakes, but nothing world ending. I have a really hard time wrapping my head around Chupp suddenly inventing new requirements over/beyond the written TCPA law. That smells an awful lot like the typical 'legislating from the bench' crap we see in politically based cases.

But at this point, I'll hold off on spergery and see how this shakes out over the next few days/a better picture forms.
 
You shouldn't get too emotionally invested in things like this. Never forget you're on Kiwifarms -- there are no sacred cows and any side to a drama are fair game to laugh at. Also the erverlord might (read: will) laugh at you for taking things too seriously:

















I also like how everyone on both sides thinks this means the case is over. It isn't. There's still appeals. Also now both sides know what the Judge wants. Failure is an excellent teacher since it shows you how to succeed (or at least do better) in the future. For example the judge wants specific numbers for the damages caused by the defamation; next time Ty will know to provide those.
 
The only part about this that rubs me the wrong way is knowing that a judge can toss an entire case just because he feels like it. Besides that it's as everyone else is saying, cool it and wait because this won't be over in a week.

That's what happened to the Dick v. Maddox case. They ended up getting a new judge because Ramos retired and the judge was like "Lol no sanctions" and threw it out.

Since everything involving Vic vs Funimation/Weeb Wars is coming to a close, I will be retiring from the Farms due to my mental and physical health [in an actual yet literal sense, my whole entire body]. I have invested time and effort on this for a long time since March 2019, and it's - in my brutally honest opinion - an overwhelming experience. Since everything has started in the Weeb Wars, I knew I'm putting my own health/body at risk - including myself. Our health - physically and mentally - always comes first. Don't ever ignore it. If you do and end up putting your health and yourself at risk, it would be like you're throwing yourself away. That is what you must avoid. If you have IRL things to take of that do include yourself like family or anything else, then go to it. No one is a slave to any or all machines. Don't ever the negatives and any of the situations like this get the best of you and have it overwhelm you. This have been a long journey for all of us. This perhaps is a goodbye.

While Ty fucked up, I really don't think that fuckup is the crux of what happened today. I know Nick is biased, but you can usually count on him to be accurate, and he did mention that Ty's performance was 2nd worst today. From what he said, it sounds like Ty prepped for the standard of the TCPA, didn't go above and beyond that standard because BHBH had additional cases, and was suddenly told he needed to reach preponderance of the evidence instead of clear and specific. That and the amended petition being denied really threw off his balance.
 
Id kind of figured both Ty and Fuhrer got a little lost in the internet sauce. 99% of judges are fucking superboomers who are generally ignorant of social media's effects (IE Tweets) on the real world.

I don't think today means Ty is incompetent, but I do think he needs to buckle down and stay off of Twitter/Nick's streams.
 
Here's my thing on that: Ty said he and the firm were spending at least one day a week getting up to speed on this case and keeping their memories fresh. Where did all of that time go exactly? If they have time to do that, why do they not have time to draft a 30+ page brief (and attach a bunch of exhibits) within 30 days?

Beard thought he could coast by doing the bare minimum and it bit him. That's all it is.
 
Listening to Nick now - Judge Chupp was basically applying the wrong evidentiary standard to the hearing.
Chupp will probably get reamed on appeal.

A big problem here is that Vic basically can't appeal the TCPA dismissal until the entire case is wrapped up at Chupp's level - the court system does not like interlocutory appeals and the delay and expense they cause. So it'll be sucking it up, paying the mandatory attorney's fees, and then appealing after the remaining causes of action go through fact-finding and full trial.
