I also like how everyone on both sides thinks this means the case is over. It isn't. There's still appeals. Also now both sides know what the Judge wants. Failure is an excellent teacher since it shows you how to succeed (or at least do better) in the future. For example the judge wants specific numbers for the damages caused by the defamation; next time Ty will know to provide those.
If you're so emotionally involved in this case that you are neglecting your body, mental health, and/or family, there's only a few cures at your disposal:
1. Go outside.
2. Neck yourself.
3. Call your ISP and request a cancellation of service.

You could try to find balance in your life, but several spergs have kindly informed me that it can't be done, so ho hum, what are you going to do?

Bingo. Making judge means, to Chupp, that he should be spending his days at his $50,000 a year country club, knocking back Arnold Palmers and sitting in a steam room with old, naked men. Instead he had to come in today, watch a bunch of people accuse each other of all kinds of shit, in an entertainment medium that probably makes no sense to him, and get a fuck ton of tweets and pictures of dumpster fires thrown at him. He's pissed that no one respects the fact that he needs to get to his country club so he just starts dismissing shit when it gets too long winded, tangled, and confusing because he needs to get to his car already. He's two Arnold Palmers behind.

He suicided his career to help a friend out only to have some one boomer up his affadavit and then get it tossed in the trash by the judge within seconds. We can sit here and be outraged at kickvic ruining a mans career but Chuck put his on the line and trusted Ty not to fuck it up.

According to people in the room, Ty spoke about his affidavit and the points brought up in it. Chupp didn't disregard it.

And Chupp didn't give a fuck about the notary issue.

The affidavit can be used at a later date and time in the trial. This isn't the only time it will be used, furthermore Chuck can be subpoenaed and say the same thing in court. There's hope yet for Chuck's testimony to live on, it's already wrecked havoc on Funi and Sabat's lives as is.

Which means Chupp has bigger fish to fucking fry and not some bullshit that doesn't mean jack shit in the long run.

Man I was kind of okay with Chupp's judgement until hearing that. That's just dumb.
Public figures do have a harder time proving defamation. Public figure status is typically awarded to very famous people that you would expect the average person to know whom they are - e.g. Stephen Colbert.
 
Based on HerExcell's recounting and description of Chupp's tone and approach, it's very appealable. Chupp was making demands for evidence that went beyond a prima facie showing, and apparently Ty and Chupp were on different pages.

Chupp apparently was already predisposed to dismissing Marchi, no matter what was brought up. He also wanted Ty to provide a dollar amount of damages for KamehaCon, and wouldn't consider any other arguments if it didn't give him a dollar amount

Well it'll be interesting to see where this goes. The only predictable thing about this case is it's unpredictability.
I'm just mad team MoRon didn't get as blasted as I expected. Sure the ISWV sperging is funny but I had a craving for a specific flavor of milk today and I feel like I got cock-blocked.

Again, this is why you're missing the issue: Chupp treated this like a motion to dismiss. The point is, the Huber and Slatosch affidavits should have provided *prima facie* evidence to allow the TCPA to pass, and therefore discovery to force these people to make the statements, turn over their emails, et cetera.
But again, Ty boomered that up and had to file them again after the deadline which resulted in Chupp completely ignoring them. It doesn't matter how unfair that is, Ty should've had that shit drafted and notarized 4 bloody weeks ago considering what a silver bullet Slatosch information was going to be.

Having a lot of the actions of the defendants occur over the worldwideweb makes its that much harder for
boomer judges to understand. Real world stuff is hard to prove as it is, the internet is a whole nother can of worms, specifically
twitter and its shifting rules and principles, hell even their UI.
I reallly hope that in appeals Vic gets justice. Sometimes thats what it takes to win.

It's impossible to show how much Vic suffered from his KamehaCon cancellation, and re-invite. It's impossible to show the dollar amount that was brought in or lost, and that's what Chupp was demanding.

He didn't care about any other convention, he apparently focused on KamehaCon
