I mean, I hope you realize that this entire thing is slowly being revealed to have been a shitshow that Marchi only escaped because she's ultimately irrelevant and managed to get a lawyer who probably did the lawyer equivalent of fighting in the alley for chump change in order to stand a chance to eat at night. Ty didn't bring his A-game and was preemptively hampered by not being able to use his amended pleading even if he was allowed to use the affidavits, Lemoine thought it'd be cute to play a slideshow, and Chupp at times was asking for evidence that the TCPA wouldn't have allowed them to get or otherwise shouldn't be required in a TCPA.
Saying that Vic ought to let Ty loose at this point is missing the point. If Chupp retains the defamation and conspiracy charges, Ty needs to learn quick how to appeal to him (not judicial appeal). Speaking of appealing, though, it also needs to be figured if they're going to appeal.

Every lawsuit has a winning and losing party. Not all lawyers can win every case. Ty made a mistake with filing so late and it did bite him. He also was on a different page than the judge and could not get him back. What hasn't been ruled out might still be enough to move forward with Chupp at the very least. Likely it's going to be a very long month.
Sounds like Ty already is in the works of a new plan. I doubt he thought he was going to walk in there and win everything, but now he has some idea how the other lawyers function and how the judge thinks. Likely he lost more than he anticipated as a worst case scenario so that plan will need to be redrafted but likely he'll figure out where to go from here. Or as the weebs like to put it, he'll gain a new power up after being utterly crushed and kick their asses like any good shonen protag.
