I mean, it's possible that this was his first time doing TCPA, somehow. But I don't think that "lack of understanding" or even "incompetence" were the issues. At least, I disagree with the particular connotations of those terms, here.

I mean, I hope you realize that this entire thing is slowly being revealed to have been a shitshow that Marchi only escaped because she's ultimately irrelevant and managed to get a lawyer who probably did the lawyer equivalent of fighting in the alley for chump change in order to stand a chance to eat at night. Ty didn't bring his A-game and was preemptively hampered by not being able to use his amended pleading even if he was allowed to use the affidavits, Lemoine thought it'd be cute to play a slideshow, and Chupp at times was asking for evidence that the TCPA wouldn't have allowed them to get or otherwise shouldn't be required in a TCPA.

Saying that Vic ought to let Ty loose at this point is missing the point. If Chupp retains the defamation and conspiracy charges, Ty needs to learn quick how to appeal to him (not judicial appeal). Speaking of appealing, though, it also needs to be figured if they're going to appeal.

Oh so that's what HerExcellency was talking about in the Gator stream (I don't know the timestamp, I'd have to listen to the stream again). She said that looked like a photo-op, especially since we know the Dallas News (or at least the reporter who was there) is on Monica and Jamie's side. So it makes me think that had things gone more Vic's way today, they'd still find ways to twist it around into framing Monica and Jamie as the real victims who are being screwed over by the court system and the patriarchy.

Oh yeah, definitely! But we can't change what happened (even though I'm still confused as to HOW it happened, but whatever), only how we respond to it. Regardless of what happens, sleazy companies are now distrusted, VA's are revealed to hate fans, and assholes are exposed. This is always a good thing.

Not all lawyers can win every case. Ty made a mistake with filing so late and it did bite him. He also was on a different page than the judge and could not get him back. What hasn't been ruled out might still be enough to move forward with Chupp at the very least. Likely it's going to be a very long month.

Sounds like Ty already is in the works of a new plan. I doubt he thought he was going to walk in there and win everything, but now he has some idea how the other lawyers function and how the judge thinks. Likely he lost more than he anticipated as a worst case scenario so that plan will need to be redrafted but likely he'll figure out where to go from here. Or as the weebs like to put it, he'll gain a new power up after being utterly crushed and kick their asses like any good shonen protag.

I... have no rebuttal for any of that. I'm still trying to wrap my head around this whole thing. I just dislike how the judge can do these things without getting in trouble or anything (and it's not like he can be corrected).

The other issue is that Ty's first filing might not have been allowed due to Rule 11 even though there is apparently a rule that allows amended motions and technical difficulties.
Of course we'll have to see what Chupp actually said but it does seem like Chupp was being quite biased due to allowing the defendants to file things late (even under Rule 11 agreement), and other shenanigans.
We also can't rule out that Chupp can always throw out the Defamation and Conspiracy within these 30 days.
As such I wouldn't be surprised if Ty is already getting everything ready for appeals + new judge right now.

That reminds me... why did BHBH introduce the TI law firm right before the hearing? Was that a preemptive move to prove TI because they knew it was being thrown out? The timing is oddly suspicious.
