I just thought of something hilarious..... if what Ty said means is that the second round begins.... how pissed is Chupp going to be that his workload increased since that's what got him so pissy in the first place?
I doubt Chupp is pissed so much as baffled by the levels of Internet autism that have been gracing his Facebook. He doesn't know what to make of it and wants a mediator to explain in a report.

This is probably the best possible thing that could happen for Vic.

We all know why Ty would want this. Vic has receipts for everything. He will be able to review them in detail with a mediator and explain matters of law relevant to the case. More importantly - the other side will have to explain them to a lawyer.

Think about what KickVic has: statements from Jamie where she says Vic sexually assaulted her in front a room full of people, and a video that shows that didn't happen. Statements from Monica where witnesses contradict her. Statements from Ron that are factually untrue. Statements from Funimation / Sony that demonstrate an investigation did not take place.

Unless I missed something, no written order has been issued dismissing the causes of action against Jamie. That might be a big deal.
 
Now i understand what Nick meant by something he had never seen before. A court ordered mediation in the middle of the TCPA is rather odd. I personally think this is a good thing for Vic.

While i would prefer Vic to literally crush them in court for all their worth, getting funi or even moron to play balls might be beneficial for him. Reminder that sabat is likely the next target. Guess who is the other moneybag to go after if funi dips the fuck out of this lawsuit? Sabat and his company okatron.

From ty's tweet of the lawsuit finally entering second quarter i think the defamation is very likely to stick and judge chupp just want this shit over with instead of continuing the lawsuit and appeals likely to follow. Also remember guys, this is Vic's lawsuit. The court remedy for reputational damage is usually money but that might not be vic's purpose in all this. If he can get some of his reputation back this would be well worth it for him.
 
I used to be a mediator a long time ago and I can tell you, right now, court-ordered mediation only works if both parties are willing to reach any sort of compromise. It's difficult to compromise between "I want my life back" and "I want you dead".

Unless dying a little on the inside every day counts.

That's why I quit, incidentally.
Even the very minimal of "I want your clients to retract their statements," won't be an option for moRon, since their entire narrative that they have been spewing will be all for not.

Honestly I want MoRon to be on the hook for their own fees. They intentionally racked up legal billing hours thinking vic would be paying for it.

That was made before I learned Ty arranged the mediation which paints a very different picture. Either he's desperate (Ty, Chupp, or both) or Chupp is going to give Ty more than a bone.

i mean yeah we all know that mediation wont work. But it's the implication that mediation is even an option according to Chupp that is important here. Mediation being an option means dismissal isn't.

Yeah, the timing says something. This wouldn't be happening if the Defendants were about to exit.

The Judge also said if mediation fails, he will rule on all outstanding motions the next day. He hung a pretty big sword over everyone's heads.

Would love to know what this means for the 30-day ruling window on the TCPA motion to dismiss.
Honestly I don't think Ty arranged the mediation, not directly, more likely, he just stacked the deck so Chupp had to do something to correct things.

Funnily enough the Dallas newsbich may have contributed to this, with this case becoming mainstream (or more like slightly newsworthy if we are being honest).

Chupp dismissing the charges in the stupid manner he did, would have been a small issue even if it was appealed, but since things may be newsworthy his fuck up is a bigger deal so he needs to mitigate it, thus we have mediation.

Imagine if this was the case, Lemoine attempt to rig the public opinion may have pushed his clients into a position where Funimation has all the reasons to fuck em up to save themselves, where if instead TCPA had gone according to the book they would still have the appeals before Funi was in a openly antagonistic position.

More like a bored idiot who wishes he was a judge gets assigned to hear two groups of people screaming at each other while the lawyers get paid, nobody agrees to shit, and it's a huge waste of time for everyone. What's there to compromise on? They want his head and balls. Does he agree to just let them chop off his head and he can keep his balls?

yeah, the mediation thing tells me the judge isnt dismissing the rest of the cause. There would be no need for mediation if it was frivolous enough to not pass the TCPA because hed just rule they were dismissed and wash his hands of it.

I'm assuming there's no different course of action than if Chupp announced he'd rule Oct. 4. Settlement was always an option that would open up after TCPA. I'm assuming Ty wants discovery wrt to tracing things back to Sabat and/or others or the equivalent in the form of a voluntary deposition or surrendered evidence. Without that being part of the settlement, I don't think there will be a settlement.

Are you referring to his head, as in the thing on his shoulders, or the head, as in the bulb at the end of the shaft?
