It's an interesting question. Generally, the time to appeal ticks from an adverse ruling. Usually, this is effective on the date of a written order making it so. However, what if the judge makes it from the bench and either never issues a written ruling or issues it later? If the judge didn't issue an order by the 30th day now, would it count as missing the deadline and denying it by default as to all causes of action?

Or has he already dismissed it? He said he dismissed it. He has the power to do that. Does the 20 days appeal deadline start ticking from that date, or as assumed, on the issuance of the final order before the 30th day?


Could he, in theory, have this order unsigned and gave the mediation (which is causing its own brand of exceptionalism on both sides) as a final chance for both sides to peacefully settle this? If he rules the next day with no settlement does he sign it retroactive or from that date?

Edit: Sorry found answer about this in Texas Rules of Civil Procedure 306(a)(4). At least I think it applies. Tl Dr it gives up to 120 days from day of dismissal.

Armchair question here. Curious as I have to make arguments for healthcare for a reason.

1) Is it feasable he's holding off signing to see if both sides will mediate?
2) If 1 is correct, can either side nail him for that?

I'll take the L or Autism but it is a curious question imo
 
That was made before I learned Ty arranged the mediation which paints a very different picture. Either he's desperate (Ty, Chupp, or both) or Chupp is going to give Ty more than a bone.


I can't say what Ty's motivations are but I was involved in a lawsuit where someone tried to steal songs of mine and the case spun wildly out of control. My lawyer suggested a mediation as an attempt to settle. I offered the crazy bitch (even though she wasn't entitled to it) a trademark I owned associated with the songs, which is worth several thousand dollars, the lyrics to the songs (I was willing to write new lyrics), and a number of other things, but not the actual songs or the music and arrangements. Of course the mediation failed and the case went before the judge.

After the mediation failed, I had told my lawyer that I wasn't surprised it failed and I didn't even know why we did it because she was never going to settle for anything I offered other than full ownership of the songs/music she wanted to steal.

My lawyer told me though that wasn't the point. He knew she wouldn't take it as well, but now it's on record to the judge that I attempted to be reasonable and actually offered her items in a significant dollar amount to end this case and she rejected any talk of it so now she's clearly the unreasonable one.

Yes, this is what mediators are for. And this is the brilliance of this move.

Just a thought, but what if "ALL parties" are called for mediation because Chupp read all the files after the hearing and is now reconsidering his previous rulings ?

I posted earlier, Chupp had two choices an appeal by Vic or an appeal by Moronica. He has a choice, pick the appeal that is least embarrassing. That sounds like the KV side. Probably hoping the KV side is smart enough to figure that out.

Seems he found a 3rd way out.

There's a 4th way out, get more death threats and recuse himself. He just needs to hand KV a loss and he'll have more than enough, ISWV may or maynot have learned its lesson, too.

Looks like they finished their warm up and began their super deep stretches, I wish I was that flexible. Does T.Greg even have work with how much time he spends on twitter? I imagine him having a meeting with a client and spending the entire time tweeting into his #threadnought for the internet e-pats.

It really makes you think why the Judge ordered Marchi into the mediation.

Really just makes you think.

Because she has every right to tell Vic to eat shit and pay her.
But if it is like I said before and Chupp is saying "yeah I changed my mind, settle so I don't have to embarrass myself by backpedaling in my decisions." If Marchi doesn't go to mediation or goes trying to negotiate from a position of power and the judge backpedals she would start the race with everyone else having a headstart, and with the option to throw her under the bus to save themselves.

Mediation is a Battle Royale when there are separate defendants, and Funimation has the big guns while everyone else has a stick.

Again this is dependent on the idea of Chupp backpedaling, but that seems to be the most likely scenario.

I'd say the judge has two slightly different choices

  • Dismiss all cases and get successfully appealed.
  • Have Vic fans REEEEEEE at him for months

  • Dismiss almost nothing and bring Marchi back in and get unsuccessfully appealed.
  • Have KV REEEEEEE at him for years and Dallas news run hit pieces. Meet the next Kavanaugh!!!!

It's a bit premature to say that Funimation has the big guns, we don't know what Monica or Jamie could offer to Vic about Sabat & Cie.
