When I was asking this, one told me it was not our job(which though not incorrect, it still does go against what kiwis would normally do), and another told me that it would have just invited unwanted trouble. Honestly I think we all wanted to believe he would be a proper judge that would do his job. If vic had his case dismissed based on lack of evidence that would be one thing, but we got a judge who dismissed it simply to remove it off his docket and because he is a lazy piece of shit that rather have the appeals court do his job.
In fairness, I think that initial push back was more to prevent falling into the holes gamergate fell into. Namely, a moron from this site or watching this site could have harassed the judge and then KV would have responded with, "Kiwi done it!"

Considering this entire case is focus on optics and the tendency for people to full idiot and get involved, it was a valid concern. Only now do we see that the heads up would have been nice. But as they say, hindsight is 20-20.
 
Hrm. Apparently Chupp has had more than one writs of mandamus, according to Nick.

There's two, In Re Salazar (which @AnOminous already told us about) and In Re Dakota Directional Drilling, from what I've found. And that was just from googling.

Allowing counsel to represent a party they're not authorized to represent is such a strange fuckup I have no idea how you'd even make it. Maybe he just ignored the law and blew it off. It's in serious "what the fuck" territory.

Well, we saw that in the TCPA hearing. Chupp's stance was basically "screw the law, this is my courtroom and I know what's right."

Because this is Weeb Wars and of fucking course we'd get a lolcow judge.
 
He should debate drexel because he said drex wasn't a real nigga because he grew up like "nick", this is the same dude with the Confederate flag as part of his logo and he wants to say drex isn't a true black man.

When MBA was on the stream with Drexel, he sucked off Nick and Drexel, called himself a black conservative and was agreeing with most of what Nick and Drexel said. He truly is a eunuch man with two faces.

I wonder if Chupp just has a personal goal to have an entire docket that is nothing but appeal cases.

Chupp's decision was terrible, but that is why we have a court of appeals. It is my prediction that Ty is going to rebound and present the clear mishandling of the case by Chupp and they will be back in court again soon. Ty has said he is willing to take this all the way up to the Texas Supreme Court. It isn't over.

I've seen mention of the Texas Supreme Court a few times in different threads. You Kiwis that know the legal stuff: could a case like this actually go that high? Even if it technically can, what do you estimate its probability of doing so is?

It isn't me who suggested that, it was Ty Beard himself on Nick's livestream.

Yes. And pretty high considering it's a TCPA case that contains a lot of issues the Texas Supreme Court has addressed before but lower courts continue getting wrong and finding new ways to get wrong. Just as a wild-ass guess, depending on whether the intermediate appeals court gets it right, something like 20-40% they hear it if someone appeals it to there.
