Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

I will admit, my outrageous optimism regarding this case has taken a hit.
The good thing about this is that they still have next week, and that they received this letter three days earlier. They still have some time to fix it, but seriously, they can’t keep making stupid mistakes like this.

Oh, come on. It's not a fatal error, since they have until he 14th to put some money down, but Jesus fuck. This is probably not the impression you want to give the appeals court when you have people like Griftsby smugly writing "lol incompetent".

Little fuckups like this keep happening, and a panel that could include Gabriel, Sudderth, Kerr, or Birdwell might be thinking to themelves "Hmm. Maybe Chupp didn't fuck this one up again like usual."

I'll maybe attribute this to BHBC and MH getting the kinks worked out in communications, but they can't keep doing this.

I'm lawyer shopping and was considering retaining a firm that seems to operate a lot like BHBH's you get the whole firm gig, except now it seems more like "we meet once a month about your case and nobody does basic shit like delegating paralegals to proofread filings and pay court costs because nobody is actually working consistently on your case". How many fucking lawyers does it take to pay the court record fees? What did Sun Tzu have to say about this?

I know they have a whole 'nother week and it is probably more a miscommunication due to handing the case over. It is most likely on the "to do list."

I just doubt anyone wants to hear excuses right now. That hey, the check is in the mail and it will be resolved immediately making this hand wringing unnecessary.

People are annoyed and frustrated by this and should take a walk for a little while.

Yeah, that shit is inexcusable.

Ty, what the fuck is wrong with you? It doesn't matter if Vic's case isn't paying you the most out of all your cases, it doesn't matter that you felt you had this in the bag.

This case is high profile for the exact reason that the whole fucking world is watching you, and fucking up here means that everyone now knows. Errors now and again are one thing but this is grossly negligent, and I honestly feel this is 100% on Ty.

I'm hopeful that Martinez Hsu will do better but they have to sort through all the dumb shit Ty did. I've seen Hsu's name come up having done teaching and conferences so I'm hoping that means he has the smarts to make this work. But god, fucking Ty man. Just when I started liking him again.

My biggest concern, after the screwups a few weeks ago, is that this case just isn't that big a deal to BHB[K?] . Like maybe, in spite of all of Tybeardicus' lip service, they have much more expensive, and hence, important cases to be working on, so this gets short thrift. And if that's how it is, so be it, but I wish they would just admit (particularly to Vic), "you know what, we just can't handle this case, we're sorry", and hand it off to someone who is willing to take it seriously. There have to be at least a few more Sam Johnson's (I think that's Marchi's attorney) out there who will at least remember how to notarize things, and file papers and payments on time.

And it just occurred to me - you guys did a bunch of their work for them, in terms of researching and archiving people and events. So this hasn't even been as much of a burden on them from the start as it could have been. Sigh.

Okay, gonna powerlevel a moment here.

I work with lawyers. This is TYPICAL stuff that is done. You file the appeal, and if other stuff gets in the way, you delay to give the payment schedule until after enough of the other stuff clears.

This is normal. Everyone here needs to take a chill pill or something.

Is it normal in accelerated appeals with a drastically shortened timetable?

This is something I've worried about with bringing all these lawyers in, too many cooks in the kitchen. If you're too busy working on other cases to do your job competently, then a little fat trimming may be in order.

Looks like Ty was served?

I didn't feel like given txcourts another 70 cents.

I was planning to get the full document, but re:SearchTX is acting up.

EDIT: The cause was my VPN. Odd, as this was never an issue before.

Anyways, here is the full document (EDIT: sorry, I misspelled "subpoena"):

You know, after every time something happens that makes Vic's counsel look silly, this sort of thing gets said. "It's totally fine, it's completely normal, everyone does it all the time". And...so far, it hasn't been fine. At a certain point, maybe people don't have to give them the benefit of the doubt?

A random power leveling person saying this is totally fine despite there being no logical reason for it, and at least one actual lawyer expressing skepticism? Hmmmm, I'm not inclined to charity here.

If there is any party that should care about this case as much as Lemoine does, it should be the fucking plaintiff. Nothing about any of the filings has shown that the plaintiffs even want to continue pursuing this case. If Ty didn't have the time to take this case then he shouldn't have in the first place. He could have just referred Vic to Hsu and be done with it.
