What is kind of great about all this is you can tell Ron is trying to find options with Lawtwitter, yet not one of those mother fuckers have tried to literally help Ron other than "That's the legal system and it sucks". I mean the guy is getting charged to subpoena Nick, which never happened. How bad is it that non lawyers are suggesting fight your bill and lawtwitter is just like "yea Lemoine should be paid that much". What is even better though thinking about it, Ron is probably asking why the case didn't get thrown out sooner. He still thinks it was a smart move to do those depositions instead of just immediately filing for the TCPA. And he probably has yet to realize that Lemonaids really fucked him over in that billing. I can't really tell what Toye is saying or what the full context is, but if the presumably licensed lawyers of lawl twitter are actually advising Toye and omitting that the Texas Bar Association has a fee dispute resolution procedure that is often a cheap and effective way of addressing fee concerns, it's straight up malpractice.

Whether something like legal advice over the Internet can, inadvertently or otherwise, actually rise to the level of creating an attorney/client relationship to the point of triggering competence obligations is extremely context sensitive.

That said, whether it does or not, anyone who talks to someone in Toye's situation and does not at least mention such options is, at the very least, incompetently doing a disservice to a member of the public.

Ron should be consulting independent counsel to see if he has a legitimate claim to lower or eliminate fees churned by Lemoine for utterly frivolous and pointless activities that advanced his interests in no way, but advanced Lemoine's greed instead.

There is no way a quarter of a million dollars to file a fucking motion to dismiss is legitimate, and nothing else Lemoine did was reasonable in the least.

This was their own doing. They purposely played games and literally banked on the TCPA awarding all fees to them. I had a feeling since MoRon kept adding "Super" lawyers to their side that they wanted to incur high fees in order to make Vic pay as much as possible. I think they wanted to screw over Vic in any and all ways to make sure he couldn't work or eat ever again. So, it's funny to see Ron getting upset because things not going as planned. Play stupid games... win stupid prizes.

What is funnier is that if they just properly filed the TCPA right away, it probably would be even harder to get past than it is now. Without what little discovery that did happen, there wouldn't be as much evidence for Vic to prove a prima facie case. I will absolutely bust my gut laughing if this gets through appeals. It absolutely deserves to make it through appeals. MoRon deserves it for the shit they pulled.

I would say its a mixed bag of eagerness from both sides. I agree with you some of the things were most likely MoRon running up the bill due to thinking it would all get paid back aka the depos and such. But I also think Lemonaids thought he found his gravy train and ran up the bill on some things which were out of MoRons hands aka the huge amount of billed hours for prep/research. And there are some things where they both thought it was a good idea like going after Slatosch, Ron wanted to prove he was a liar and Lemonaids needed something to bring in appeals because the judge never struck the affidavit from the record.
