Freedom has a price to pay, that is what people have lost sight of, it sucks when an asshole exploits his freedom in a bad way but that's the price you pay because the alternative in the grand scheme of things is worse.

They've been trying to make it out to be a war-crime since they were old enough to read.
What the papers keep NOT covering, is that it was a fighting retreat in a lot of areas. Any unit approaching them got fired upon, so they said fuck it and went weapons hot in a target rich zone and fucked up everything in sight.
But the press was dying for their war crime to report on and the war was over so fast they didn't get any burnouts slash-burning mudder villages like it was Nam in 69, so they began thrashing around looking for ANYTHING to go "Army Man Bad!" over. (They held a couple of "symposiums" regarding all the 'war crimes' in Iraq, included in which was air-dropping food to Kurds because three times the retards stood under the pallets and got crushed)
It was the first time in decades the US military had engaged in combat against a supposed "parity" force (The Iraqi's were HILARIOUSLY outclassed) and were actually outnumbered with pretty serious casualty estimates in the pipe. (Up to 3/4 of the First Wave were a possibility)
So when the Iraqi's saw the US Army thundering toward them playing heavy metal and shooting anything that looked remotely un-American, they hauled ass. Not just the dudes in Kuwait City, but ALL of them. The ones that stood in place got fucking owned pretty bad as command kinda sorta well, pretty much, lost control of everything as objectives started racking up and part of the commo net collapsed.
Every time a unit (Usually tankers) tried to intercept, the Iraqis would open fire and/or go around. Finally, they said fuck it, because it was pretty much a given they were going to get into Iraq, regroup, and counter-attack, so they said "Fuck it!" and just opened up on the convoy.
At no time did they throw up the white flag, or throw away their weapons, or attempt to surrender.
It was a fighting withdrawl, and thus, a legal target.
Even if they weren't popping shots, they weren't surrendering, they weren't fleeing with no objective.
You are allowed to follow up a rout and destroy them.
This whole "They're retreating, you can't attack them now!" is bullshit wishes by someone who's never so much as smelled a wiff of cordite.
Someone out yelling "They're retreating!" should immediately be followed by "KEEP UP THE PRESSURE!"

Here's the thing: You don't get to invade another country, then, keeping a hold on all of your shit, run back to your home country yelling "NO TAG BACKS!" just because the war's started and you might get your ass kicked. You're STILL a valid target.
There's been bullshit, like the reporter who uncovered My-Lia in Vietnam (Seymour Hersh of the New Yorker) claiming that he PERSONALLY witnessed a tank platoon killing hundreds of surrendered Iraqi's at one time. Except he couldn't name the tanks, couldn't name anyone involved, couldn't list the unit, and the unit he did eventually claim did it, well, they never left Saudi Arabia because of logistical concerns.

Iraq tried to retreat, still maintaining their military strength by taking their equipment with them, opening fire on any ground units that engaged them, to include persuing any who broke contact and fell back, and in order to stop them, and break the survivor's will, and destroy approximately a fifth of Saddam's remaining forces PER HIGHWAY, they were hit with everything.
Why is it a war crime?
Because the US won that shit. That's why they try to memory-hole the first Gulf War and the invasion of Panama so hard.
