This is the impression we were given from our Canadian Kiwis. That until that $6000 is paid, his complaints will fall on deaf ears. One of them would have to confirm again but I’m 98% sure this is the case.

I’m going to have to double-check this, but I think the duty of procedural fairness would require at least some consideration of the case. That consideration could probably just be a paper hearing to say “nope still a bigot”. I’ve looked before for precedent but I don’t think anyone in BC has been this nuts before.

One option would be for the tribunal to require that Yaniv post security for costs. Yaniv then couldn’t continue the complaint before giving the tribunal whatever they think is sufficient security (probably $2000). The original ladies could then seek to attach the security paid in.

Whether the tribunal does this would depend on how much merit they see in the leg waxing case vs their distaste for Yaniv.

Dumb question here. Does the HRT have authority to collect on that $6000 leaf money?

Yes, but it is the responsibility of the original waxing ladies. Jay Cameron filed the tribunal award with the BC Supreme Court registry and it’s just as enforceable as any court order.

He doesn’t want the wax. That’s the point. That’s why he won’t go somewhere that will do it no questions. His whole scheme revolves around everything but getting waxed.

Perhaps this presents cause to establish a vexatious litigant procedure at the BCHRT.

There already is one. This asshole, Mokua Gichuru, was declared one last February so Yaniv wouldn't even be the first. I don't know if Gichuru was even the first, but like Yaniv, he's an asshole who likes to sue people he claims discriminated against him for being black, disabled, etc. Unlike Yaniv, he's an actual lawyer (but not currently licensed in Canada, not sure if the equivalent of a disbarment was involved) so he can easily bring cases and weaponize the HRT (and the other BC courts where he's also been named a vexatious litigant). Reading the BCHRT decision here seems to suggest that Gichuru filed dozens of cases and actually won a few before the HRT got sick of his shit and slapped him with a 10K fine and named him a vexatious litigant. Unfortunately, the order against him only prevents him from filing cases which fall under a single section of the code.

That guy was at it for over a decade though. Yaniv's racked up quite a few cases already and hasn't had a single HRT decision in his favor (although he's extorted money through settlements) and isn't actually a lawyer which seriously limits his power to weaponize the tribunal. Worse, Yaniv's displaying his blatant racism the entire time since he only sues immigrant-ran salons, while Gichuru's cases seem to be mostly him bitching about racism. So Yaniv's likely on his way to getting a vexatious litigant order against him in the tribunal.
