A trans woman who threatened shop staff with a claw hammer escaped prison after a court heard there was no way to confirm her gender.
Leila Le Fey, 40, admitted entering a Budgens store in Brighton last year in a bid to steal alcohol, and brandished the “terrifying” weapon at Enoch Adetayo, the shop’s manager, before assaulting him.
However, she was spared a prison after a judge reversed a custodial sentence which would have sent her to a men's prison.
Lewes Crown Court heard that Le Fey had completed gender-reassignment but had not yet obtained a Gender Recognition Certificate (GRC) to that effect.
As a result, despite living and identifying as a woman, Le Fey would have had to serve her sentence at a male-only jail because the Home Office and Prisons Service would not recognise her as a woman without a GRC. This would not only have created intractable accommodation problems but also caused substantial and unintended trauma for Le Fey.
However in an eleventh-hour U-turn, Judge Stephen Mooney called Le Fey back to Lewes Crown Court just an hour after jailing her for six months.
He reversed his decision to send her to prison after hearing that the only way Le Fey could prove her new gender would be an "undignified examination", one which court staff were not prepared to do, her barrister said.
"Issues have now arisen,” Judge Mooney said. "We live in a society which acknowledges and embraces diversity and allows and encourages people to live the life they want to.
"Sometimes society does not make the necessary or appropriate adjustments in all ways it can to reflect the adjustments of society as a whole.
"Having reflected again upon the impact an immediate custodial sentence would have, the difficulties there are and the intractable problems the prison service would face, I have reconsidered whether imprisonment must be immediate."
Barrister Rebecca Upton said Le Fey did not have certified evidence of her gender reassignment and would have to go to the male-only Lewes Prison.
She could not be kept in solitary confinement there and would be vulnerable in a male-only prison, Ms Upton said.
"When you took out the claw hammer it must have been terrifying," Judge Mooney said.
He told her there was "no excuse" to wave the hammer and assault Mr Adetayo.
Earlier, Rowan Jenkins, prosecuting, said Le Fey went into the store at 4am on November 6 to steal the wine. Mr Adetayo took the wine off her and challenged her, at which point Le Fey pulled out the hammer from under her other arm. She tried to grab another bottle of wine and leave but police arrived and arrested her.
Ms Upton said her client has battled with drink and drug addictions and kept herself out of trouble since 2014 before a relapse last year.
Le Fey, of Providence Place, Brighton, who admitted common assault and possession of an offensive weapon, was given a six-month suspended sentence, with 30 rehabilitation sessions.
The court heard that Le Fey has two previous convictions for possession of a knife in public and more than 50 previous convictions.
Had Judge Mooney not reversed his decision to send her to prison, Le Fey would have received the mandatory 6 month sentence for possessing a weapon in public following that 2014 conviction.
Judges have the legal power to exercise discretion when handing down custodial sentences for crimes which would usually land a defendant in prison.
If a person could be seen to be made particularly vulnerable by serving a prison sentence so much so that their sentence will be more severe, then judges can take that into account.
Judge Mooney was appointed to be a Circuit Judge in April 2019. However in his short time in the post, he has already had one of his sentences reviewed and issued an apology following accusations he was too lenient.

He gave a teenage boy, Bradley Garrett, a two-year suspended sentence which was challenged by the public for being lenient

After Alexa was murdered he deleted his post and deactivated his social media and people were quick to call out his fishyness. The many people that knew Alexa gave accounts of her being shy and guarded because she has bed been the victim of sexual assault, her mirror was her protection this man created a fantasy in his head and stuck with it as if it were reality. Alexa would go into bathrooms and express her feelings on the mirrors, she would write messages Like these "Never abandon or mistreat your kids mentally/ physically, please."

The guy getting lambasted in the PR troon murder finally had his Facebook unsuspended and posted more details about the situation. If his account is true it sounds like he reported the bathroom peeping to a nearby cop, who then blew it off and refused to question Torres, take him down to the station or even make a report. Torres left the McDonald’s and it’s sometime later, in an unrelated incident, that he is harassed and killed.
This dad, Carlos Fret Negron, says if there hadn’t been video of the murder and the assailants then he thinks he media would’ve accused him of the crime. He also seems to suggest that his young daughter was in the bathroom at the time with the mother when this all went down, which adds another layer to the story.
The man murdered was identified by his family as Carlos Alberto Negrón Luciano, but he used the name Alexa Torres.

The man who reported on the social networks the presence of transgender women in the bathroom of a fast food restaurant in Toa Baja last Sunday, returned an extensive message on his Facebook account after the murder of this early yesterday.
Carlos Javier Fret Negrón began by saying that he does not support the way they executed Alexa Torres . "I will never agree with what happened to that person and there is the other fact of what happened at the McDonalds that was the one that I reported on social networks for the total lack of attention of the officer."
He also said that what he reported on the networks was the incident in the bathroom and that he urged parents not to leave their children alone.
Fret Negrón also argued in the long text that he is not guilty of Alexa's violent death, but blamed the officer who answered his complaint.
"The only culprit of what happened after the initial incident is called Fernando Ortega 19195 who was the officer who came to the establishment and in less than 8 minutes and even without having taken the data to the other people involved letting go the individual who was later found dead. "

People who committed the crime saw a person dressed as a woman, harassed her, stalked her and then decided in less than 40 seconds that they wanted to take her life FULLY INDEPENDENT to what happened at the McDonalds and what I reported on social media. What I did was to alert people to never let their children go alone to the bathroom and always be cautious before all situation but unfortunately when the murder of this person occurred because everyone looked for someone to blame and raised their finger and decided from one day to another that I was guilty of the death of this person because of all the people who shared the news specifically of mine had more impact than the others.
When they can be objective and I know that it will not be at this moment they will be able to understand that neither I, nor the mothers who cared for their children and shared the news, nor my family and friends were at fault in what happened.
The only culprit of what happened after the initial incident is called Fernando Ortega 19195 who was the officer who came to the establishment and that in less than 8 minutes and even without having taken the data from the other people involved he let the individual who later appeared dead.
The agent should never have let that happen and had the obligation to do his job at that time and his job was to intervene with the person and take it to the barracks to create a record and a file, then if in prosecution the people involved decided not to continue with the case, then, is the prosecutor who decides if he continues with other tools or if he proceeds to activate the 408 that is appropriate for people who suffer from any condition or mental state and took him to the institution that the state believed was appropriate to attend to this person.
The most important part of all this puzzle that they did yesterday in the networks was the video that uploaded Telenoticias and TuNoticia where you see the exact moment where some individuals committed the crime and uploaded it, because if that video had not existed already all of you would have done my case in the networks, they would have declared me guilty and they would have also sentenced me. A video where it is clearly seen that it was a total hate crime and where they could hear that those who committed the brutal murder did not do so in revenge for what happened earlier, or for the consequences of the publication, or for reprisals for what happened with some child, that was not so and everyone could see it.
People who committed the crime saw a person dressed as a woman, harassed her, stalked her and then decided in less than 40 seconds that they wanted to take her life FULLY INDEPENDENT to what happened at the McDonalds and what I reported on social media. What I did on the networks was to find a tool to alert people who love their children to be always attentive and never neglect them because if tomorrow I am with my daughter in a shopping center, park, school or any public place and an event happens again where a person enters the bathroom and lights with a mirror to see and violate their privacy can be sure that I will act in the same way and encourage the corresponding authorities, not only because I love my daughter and give life for her in every moment and my whole life, but because I also care about any other child that may be in that situation and I put myself in the place of his family as a father that I am and I hope that if that moment happens another someday the agent who shows up if he does all his work and the system does not fail again as today is failing me, I fail my daughter, I fail your children and I fail a person who ended up dying when it should never have happened and that's why what was right was done at that time, which was to call the corresponding authorities.

All this child knows is something enormous and wrong and incoherent and alien is thrusting itself at her and all the adults seem to think it’s hilarious while her little confused face is trying not to actually cry because she’s trying to be good...my god.
