We know when he claimed it, and transfers or expenditures can be presumptively fraudulent within a certain amount of time before then, but they can also be fraudulent a longer time beforehand if the debtor was aware of deepening insolvency and continued to worsen his state. This is why his lawyer didn't want him answering this stuff if possible.

She had no real basis to tell him to refuse to answer but you could notice her being disruptive and interrupting a lot at this point to keep Phil from saying shit any more stupid than he's already seen. If your lawyer seems to be getting agitated, but isn't telling you outright not to answer (because they can't), TAKE THE HINT. Say as little as possible. Get evasive.
There were times you could tell Rochelle was panicking over some of the things Phil was saying. The questions Nancy asked were designed to get Phil to lie and every single time he fell for it. He does own electronics for personal use he didn't report. He didn't disclose he was getting his tips via Streamlabs. He couldn't give specifics about what his business expenses are (muh tax attorney!). He couldn't even answer what kind of business Burnell Productions is (because it's not an actual business and exists in name only). He couldn't give a straight answer about anything because he did exactly 0 seconds of preparation and was completely oblivious to how overmatched he was. I imagine after the meeting was over Rochelle put her head in her hands and asked herself what she did to deserve this dishonest piece of shit as a client. Phil waddled off thinking everything went great.
 
I don't know why he started sperging about tips. "Tips" in the traditional sense are still considered taxable income by the IRS so I don't see how that WOULDN'T factor into his income. He also has a second Paypal which is interesting since he's declaring personal bankruptcy yet combining all of his personal and work assets into a single claim, which allegedly he's able to do. So he seems like he's one foot in the business realm and one foot out with that second account.

In WA State (Powerlevel: I used to live there), a non-taxable, monetary gift was any amount up to $999.99. Now I don't know if this applies per transaction or the sum over a period of time (like a fiscal year). More research would be needed.

He's only been repeating that same spiel every day for years on end. It's probably a deeply ingrained reflex by now. He probably didn't even need to engage any conscious thought process to rattle that all off.

He probably assumes that when servers or bartenders in restaurants makes tips and don't report them, it's what is generally done. Servers and bartenders are required to tax them legally, but no one does that and governments don't care about such small fry. Phil sees this happen and just assumes it's how the world works

You have to report enough not to attract attention. If you claim to be a waiter who makes no tips they're going to nail your ass. They can do what is called "imputing income" and just slap you with huge fines and penalties and then throw you in prison if you don't pay. If Phil is doing that he's going to get caught and he's going to get fucked hard.
 
I’ll never again be surprised by the astounding laziness DSP shows towards literally everything now. Any specific question the trustee had for him, he had to give approximate answers. You’d think ANYONE in this situation would have all of the relevant information in front of them, so they could answer important questions like: “When did you purchase the Connecticut/Washington property?” “When was the last time you made a mortgage payment?” OR “What type of business do you run?” .... DSP couldn’t even answer if his “business” was a sole proprietorship or an LLC. “Uh, it’s DEFINITELY not a corporation...” Good job at making it obvious to the trustee that you couldn’t be bothered to give a fuck about any of this.

Also, I was almost doubled over with cringe when she was asking him if all of his manchild toys were for “business purposes only”, and also when DSP tried explaining to her what he does for a living. Any other 37 year-old would have felt supreme embarrassment.

This meeting went so much worse than what I expected. Also, do any of you think If he would have shown up for his originally scheduled meeting a few weeks ago that he wouldn’t have been scrutinized as much as he was Thursday?

He had to explain that he makes his money by acting like a total sped, playing videogames for children badly, and begging for money from children who get it from their parents.
 
I wonder if he said that he does "internet content creation" because he was just too embarrassed to say that he plays video games where his viewers pay him or because he's actually exceptional and believes that live streaming is a job just like any other
I'd argue that it can be a job, but DSP puts literally no effort into it, so I can't defend him. Having to stick to a schedule, put effort into having entertaining content, uploading highlights to youtube, fulfilling Patreon pledges and generally what most streamers do can be hard work and time consuming but Phail does not even the bare minimum in any of them so that doesn't apply.

He might as well do IRL streams every day and get the same result. I have no idea why he's still playing games.

The more I listen to the call the more I believe he is completely screwed. Everything he owns is business-related, the woman standing next to him is a complete idiot and tried to desperately help him not fuck himself over but our girl Nancy wasn't buying that shit. His pre-stream tactics don't fly with anyone who isn't an imbecile, let alone a person whose work is to profit off of people who want to cheat the system.

Based on the tone of her voice, Nancy did not buy any of this shit. It will get really bad, seeing how he lied about a lot of information (under oath). He rakes in a pretty serious amount of money, living in a gated community and owns an unoccupied property across the country, has a horrible internet reputation to the point of just looking up his name pulls 100s of results of his scams.

Furthermore, having this call streamed to the internet provides people with the opportunity to call him out on his lies, which she can also see pretty easily. I won't be surprised if any gay ops are organized to contact her with info on how he lied (don't do that, she'll figure it out by herself and you'll prove his victim fantasies to be true).

That being said this is a pretty fun storyline, pig ups to the dude who streamed it, Nancy and the farms.

I've had the chance to catch up and....this is extra large yikes with a side of wow. I listened to bits and pieces of the recording and once again just wow; to hear someone bungle and sperg their way through something like this made me laugh out loud. What also made me laugh is the fact this idiot thinks he won. Got back to "playing video games and having fun" like nothing happened. This alone showed me has shortsighted, ridiculous and unrealistic this mofo is.

Now I don't know how PayPal works(cuz I don't really have one) but if it works and reads like a bank account(the ability to look at past transactions, deposits, balance transfers, etc, etc) than Phil with the weird shaped head is done. All his nonsense, scams, tips and phantom "donations" will all be there and we will all bear witness to the financial equivalent to prison rape...

Uhhh. .if I had to liquidate them? Uhhh. .yes. That's how much they would go for at a garage sale or something, my computer is very old haha.'
I cracked up as soon as Phil said 'garage sale'. That's not how you valuate the worth of your property Phil, you don't shrug your shoulders and guesstimate what you think some schlub with a Saturday morning McDonald's shart in his pants would buy it for if you put it in your driveway you idiot! Look up the actual fucking price of that item.

Even if Phil was allowed to re-apply, I don't think it would make a difference. I don't think Phil has anything resembling the necessary bookkeeping to make an accurate bankruptcy application. His only hope would be that it'd be "accurate" enough that nobody could be bothered to look further into it.
