The best part about this whole situation is that our buddy P.P. Burnell truly shows himself to be his worst detractor.

He doesn't have a complicated tax situation--he's a sole prop with an electronically tabulated income stream. He fell into the trap of, "I'll never get a job or pay taxes." which happens to other small business owners--they deduct everything, and find themselves in a pickle (usually getting audited).

Pahul could've done a "small business deeducshuns" for dummies" Google search or some shit like that and found out that he should set aside the value of part of his utilities, part of the value of his "gayming machines," etc. for business purposes, but instead he thinks he can pull a fast one on the actual professionals like he does his Vincents and Papas.
For all the crying about "you don't know how life works," this sad man projected his own ineptitude on "da trolls,' because he really doesn't know how fucking life works.

Nancy is probably the first real adult he's "interacted" with in quite some time--it's evident by the fact that he can't even pretend to help himself from giving his usual pre-stream spiel when trying to explain PayPal.

Nancy is not stupid--Burnell Productions isn't the only "kahntent creation" company out there--doods make hundreds of thousands of dahllers on Twitch, YouTube, etc. And don't run into these problems--this "worst financial situation of muh life" shit is self-imposed. If someone quacks like a NEET, waddles like a NEET, and snorts like a NEET, he's probably going to get his Ch. 7 petition denied.


We're just blessed with the opportunity to pull up a chair, grab some popcorn, and watch the writers do God's work

I paid that much when I first bought it back in 2006, this was years before I started my youtube career....(hours later)...and that's when the trolls negatively affected my business and put me in the financial crisis I'm in now. If anything I should charge more because this is the authentic original box of the initial ps3 release, a high quality system that still functions to this day. I've played it on several streams and unboxing videos..and people know me and they've seen my stuff. That only adds to the value of the stuff I sell. You'll make more just owning this box. You can show it to people and they'll go "Wut?! Phil used to own that?! I remember DSP. He was hugely popular back in the day, a pioneer on youtube, if you will, that's so cool!"..so yeah..uh...anyways $700 or you can get the fuck off my lawn and stop wasting my time. How does that sound duh huh? Cause I'm not dropping the price and I've already explained I need everything else like the consoles and games for my business. Oh okay thanks for stopping by asshole. Oh this was definitely out of the ordinary for a 341. Trustees are used to getting tips about cases from scorned exes and angry business partners. Nancy definitely heeded some of the weaponized autism surrounding Phil. She’s read some emails and came into the meeting knowing that he plays vidya for a living and that owns quite a bit of electronics. That’s why I wish the trolls would tone it down. A well written email with valuable information about potential fraud is one thing. A whole inbox full of links to Phil masturbating on stream is a whole other ballgame.

Box was only touched, one time, by human hands, only to take out the console, never again. And it's got the DSP autograph on it so add $150 to the $700. Based on the market value at the time of the console's release and when Phil went to WWE Axxess to get Orton's autograph it was $150. Phil's a professional, he doesn't just pull numbers out of his ass.

Yes ma'am, I not only stream games, I jack off on Twitch for my totally not children audience. At my age and with my sedentary lifestyle I need a little help rising to the occasion.


Mental health is a very valid, and serious issue. Phil needed that Brazzers account for his down time so that he can recharge and become a powerful person while streaming. Totally business related.

I don't understand the presumption that DSP is claiming his tips are tax exempt. DSP calls them "tips" instead of the more normal "donations" specifically because they're taxable. The only thing that comes to mind is when the trustee asks about streamlabs (while asking about revenue streams) and he says in confusion "Well, that's software I use to stream but they don't pay me..." which would indicate either severe myopia on his part or trying to hide the tips. Considering that he mentions his Paypal tips page I believe he was just thinking of who pays him instead of how it looks on his Paypal transcript.
More on his myopia: the trustee asks how he determines his gross income and he explains what gross income is (instead of his actual income streams). The trustee asks about his Paypal account and he explains what Paypal is (lol). The trustee expresses interest when he says "tips page" and when could have only said "my stream viewers / fans can tip me" he goes into his preloaded explanation of what tips are and compares himself to wait staff. He seemed unprepared not only in terms of remembering his own history but also in his own understanding of who he's talking to - it sounds like he was trying to explain his business to a random anonymous juror instead of somebody whose job is to review accounts.

I'm worried that he'll get too greedy with pestering Phil and end up giving Phil some kind of recourse to, idk, maybe pursue some kind of legal protection? I know creditors can't harass debtors in this country, and that consumers have ... some kind of protection and recourse against harassment. CitiTroll already triggered Nancy in the call. He'll fuck it up, I just know it.

If you're gonna do dirt, fucking keep it to yourself until the opportune moment - if it ever comes, and even then. And do it alone. Don't fucking brag about it because everyone hears everything.

I’ve never worked for tips, so pardon my ignorance but aren’t they considered taxable income that you have to declare on taxes? I’ve heard cash only tips will be underreported but his are all traceable electronic tips? I’m so confused. Is Phil really trying to hide a huge portion of his income by saying they’re tips and don’t count?

No. I'm not sure how this idea that he's hiding tips has taken hold. On his monthly income and expenses filing, his listed monthly income had to have included the tips he receives unless he has some other mystery source of income that's producing thousands of dollars a month and happens to match up nearly perfectly with the amount of tips he receives in a month.
 
I honestly can't wait for the YouTube Lawyer guy to discuss this meeting tonight. As someone who knows nothing about law he breaks it down fairly well. Also about Phil having a yard sale would be the most hilarious thing ever. I'd even go just too see if he's even good at haggling or if he's just firm on his offers. I wouldnt offer him more than possibly 200-250 for the consoles - 50 for the PS3 as a back up for old games I like. The controllers I wouldn't pay for than 25 or see if I can haggle it down to 15.

I worked for tips for many years. It's really simple.

Cash tips, you commonly under report them. It's a fucking reality of the service industry. Credit card tips, electronic tips etc are obviously reported by default.

That's kind of why customers and service workers mutually understand that cash tips are preferred. that's where the phrase 'under the table' comes from. Uncle Sam doesn't have to know about it. It's dishonest, and illegal, but no one really can put a stop to it unless there's some horrible autistic record-keeping that a business may do, and that's if they really hate their employees or if they are under incredible scrutiny by the government. In all my many years in the service industry, I would frankly have been pissed if my employer shook me down for all cash tips. I mean come on, most waiters make below minimum wage anyways.

Either form of tips (cash or electronic/credit) are taxable income, though I guess it may be a state-by-state thing.
 
I'm very late to this thread so I apologize because this has almost definitely been touched on, but the trustee literally has a month statement in front of her, explicitly asks about the "Streamlabs payment" and DSP says "I don't get paid by Streamlabs". Unreal. It's genuinely baffling. He can't be so truly dumb this is his attempt to hide tips, right? He can't think him shouting "SEMANTICS" will fly in court. Maybe his insistence on exact, deal-with-the-devil style wording it's a sign of whatever spectrum of autism he's on and he was actually confused by her not asking about payments through Streamlabs, because any other option boils down to him being a massive fucking buffoon.

This blows me away too. I've been fairly lucky in life to have the parents I have, and they taught me very early on about a number of stuff by having me "help out" with things like filing taxes, but I would have thought DSP's father from what (little) I've read about him would be someone who would be sure to report a penny someone left behind as a tip just to be safe what with being a life long working man who worked his way up to an executive. How the fuck could nothing have passed off to DSP, let alone been taught to him?

DSP even had a fucking tax crisis years ago, how the hell has he yet to separate his business and personal assets? He knows "detractors" report him, why take any fucking chances even if it might cost you slightly more per year?

He's also talked a number of times about how he uses his specific terminology because he has to report tips on his taxes. This is why I'm starting to believe it genuinely boils down to a weird autism-semantics thing.

I'm probably hypothesizing too much, but I think Phil's parents were likely too frugal and protective. We know they've lived in the same house for decades which is in a more ghetto area, and they could afford better. There's the infamous Wolverine story and Phil bitching how cheap they are. It's common for folks of Polish descent to save their money a little too much with their ancestry of being peasant slave labor in the industrial era.

I think Phil is still rebelling, which is sad for a man in his upper 30s, but it doesn't look like he got that out of his system in his young adult years like most do. He was class valedictorian and sounds like he was a Mama's boy.

If not for the fact that we know he partakes in Brazzers, I'd believe it because he's that much of a no-lifer. What does he do when he's off the clock? Mostly gin and wrasslin', right? Not surfing the information superhighway.
