Is the same trustee present throughout the process? If he pisses Nancy off and still manages to get Chapter 13 somehow, she's going to continue to be in an adversarial relationship with him throughout the entire payment plan. At that point her active role would be to fuck him over.

Unless Nancy is incapable of performing her duties as a trustee of the court, she will remain on this case until its conclusion.

Let's say my prediction comes true that he's kicked to Chapter 13 and ordered into a repayment plan, during which after perhaps a year or so Phil decides he's had enough and tells the government in his patented charming way to go fuck themselves and that he has no more money to give them. Jail time would be down the road and highly unlikely. What is likely is being denied bankruptcy completely, as Phil’s not just bad with money, he’s being consciously deceitful and misleading in his financial statements to the court. That’s not just getting denied Chapter 7 and forced to Chapter 13, because any digging will show Phil doesn’t pay bills and trusting him to follow a payment plan would just waste time by delaying the inevitable liquidation when he fails.

Also, there really isn’t anywhere that malice can make bankruptcy any worse than it already is. It’s all just accounting rules with no room for interpretation, really just a flowchart process, like playing as Ken in Street Fighter II. Making your trustee hate you just makes the dealings directly with them unpleasant on a personal level, but everything regarding categorization, debt levels, payment schedules, etc. are all set formulae.
