One of the major issues that comes up is whether gambling debts were incurred in good faith. Malicious bankrupts will sometimes deliberately squander money just to fuck over the creditors and bankruptcy isn't meant to allow that.
I think you hit the nail on the head. I think phil thinks he doesnt have a gambling problem at all, he thinks he is doing this for two legit and good reasons (in his head)
A) to inflate his business expenses as much as possible to actually qualify. (I am curious, when did phil start spending big on wwe champions?? was it before he met Rochelle in October? my guess is he talked to a bankrupcy attorney maybe before Rochelle who told him he didnt qualify and he hasked how he can fix it and they said if your business expenses were higher that might work.
What makes A so hilarious is Dark could have used the cash to actually improve his streams by buying stuff like more games, better equipment, etc but instead he just wanted to squander it so he can get sweaty jpegs lmao.
B) now, he is still doing it because he doesnt want to give the creditors a dime of "HIS MONEY". How much is the exemption for cash? It cant be much, $500? $1500? Dark doesnt want to givfe this cash to the creditors so he continues to blow it on the jpegs and justify in his head that at least he gets to spend his tips and not the banks.
