A murder charge (what he was arrested for) would require him to 1) want to kill the man and 2) know about these underlying health conditions so that he could expect his otherwise non-fatal actions to actually kill this man in particular.

Also, lol at the jugular. You mean the carotid? either way, that's on the anterior. He would have had to be facing the other direction.
