It's different because the fan drawing art of someone isn't going to sue who they are a fan of for looking like their drawing. If someone writes a song for a singer/band and then that singer/band acknowledges the song or accepts it, then comes out with their own song that sounds similar to the fan's song, the fan can sue the singer/band for theft of intellectual property. One thing I loved about Russ' new lolsuit during Racket's stream was Russ going on about the "unsolicited" music angle and how Swift had accepted them in the past. I'm of the opinion that he isn't a virgin. While he's certainly an unreliable narrator, he does mention how he never felt more cared about than when he went to the Bunny Ranch for the first time. He exaggerated how long the sex lasted but he wouldn't keep going back if he wasn't getting the service he wanted. He sued Murphy the hooker for not having sex with him but he didn't sue the other hookers on his "more trips to the brothels than he can count." He must've done the deed at least once.
