There are no federal laws governing the private ownership of flamethrowers or flamethrower-like devices. It's perfectly legal to buy them in 48 states and it's only restricted in Maryland and California, I believe. Using a flamethrower on someone is illegal, buying and owning one is not. Honestly, if you can trace your ansestry to North America for more than 2 generations, you're most likely mixed with something.

Edit: there was also a time when a bunch of indigenous told their chiefs to fuck off before abandoning the tribe and going to live as the "white man" do and therefore were not recorded.
