Officer-involved shooting under investigation in Kenosha

KENOSHA, Wis. (CBS 58 ) -- An officer-involved shooting investigation is underway in Kenosha on Sunday, Aug. 23.

The shooting happened near 28th Avenue and 40th Street around 5:11 p.m., after officers were called for a "domestic incident."

According to police, officers provided immediate aid to the person. They were transported via Flight for Life to Froedtert in Milwaukee for treatment. The person is in serious condition.

A large crowd gathered near the scene following the shooting.

Kenosha Sheriff’s Department and Wisconsin State Patrol were requested immediately so that the scene could be turned over to an agency other than Kenosha police.

The Wisconsin Department of Justice (DOJ), Division of Criminal Investigation (DCI) will handle the investigation.

He's still entitled to claim the shootings were self-defense, which they were. His presence there is frankly irrelevant.

You generally can't claim self-defense as a complete defense when you initiated the conflict that started it by acting unlawfully yourself. Self-defense is for the man who was acting lawfully in a place he had the right to be. So if you pull a knife on someone, then they pull a gun, you can't stab them in "self-defense." So how the conflict actually started is important.

Yet another reason he shouldn't be talking to the cops. No way he knows the legal significance of these facts, which will be very important on self-defense and whether it's a complete defense meaning he outright walks, a mitigating defense lessening the charges, or something less favorable.
 
I'm seeing this a lot in this thread and on Twitter. The law is pretty clear about the use of deadly force.

It doesn't matter if you're the world's biggest asshole, armed to the teeth like Schwarzenegger in Commando, and attend an asshole kicking convention. All that matters to the law is if your life was in danger and was the only way to preserve your life lethal force. That's what the criminal trial will determine in the coming months. This is the reason boobytraps are not legal in the US. If no one is in danger it's not lawful to harm or kill someone just for committing a crime. How threatened you felt before opening fire is something the lawyers will sort out.

The fact that multiple individuals are filmed assaulting the kid before he opened fire, and that one of the assailants is a convicted felon photographed with a weapon he legally isn't allowed to have is pretty good evidence in a court of law. You can carry weapons that you have a permit for and walk anywhere you want.

Rioters don't confer some fucking sovereignty over the streets they occupy like it's their own personal nation-state. Everyone out that night disobeyed a curfew and shouldn't have been out.
 
Tbf the kid really shouldn't have been there on his own. It's become fairly clear that rioters are completely retarded and will try to attack you if you're alone, even if you're armed.

Not saying he deserved any of this, but now we have a kid at aged 17 who has murdered 2 people and maimed another one for life and that's just not right.

How is it so hard to just not fuck with the guy who has a gun? This is the whole reason we have OPEN carry so you know he has it and will use it. This is America, not China and we are allowed to have weapons to stop ourselves from getting beaten to death. Doesn't matter if he came from 1000 miles or down the street, you don't attack people and especially armed ones. You do, your life is forfeit. Hell, I'd say trying to destroy and steal is worth a bullet too. I'm sick of mollycoddling criminals who get to steal because Burn Loot Murder is allowed to get away with shit. Just shoot them already. They steal, you kill. They burn, you kill. Cops won't do anything about it so law and order is already out the window.
 

Real talk, that is a good center-mass shot. If that hit where I think it hit, he was dead before he hit the ground.

The headshot was also some very nice placement. Again, the guy's brains were probably scrambled instantly.

Arm shot guy, I kind of want to see the angle of the shot, but Kyle did incapacitate him.

He very effectively neutralized his attacking forces, and gave them clean and honorable exits from the theater of battle. Except for the dude who was screaming like a bitch.

Police and law enforcement have not been doing the duty to protect that we have outsourced to them. That duty is our own first and foremost. We outsource it to a bureaucracy only as a means of ensuring accountability and justice. "Blake appears to have told officers that he had a knife in his possession, the DCI said. Investigators later "recovered a knife from the driver's side floorboard" of Blake's vehicle and no other weapons were found, the agency said."

Yes, you can. For instance, if the initial aggressor in a situation withdraws and is then pursued by other aggressors, self-defense will be justified so long as it is proportional. Or, as I mentioned before, brandishing (which is unlawful) may be excusable as an act of self defense. But this is besides the point--the kid here neither initiated the conflict or acted unlawfully.

That's a false equivalence. If someone throws a molotov cocktail at you and then chases and catches you, your are entitled to use self-defense. Whether you can use deadly or non-deadly force is an issue, but the facts of what happened here lean heavily in favor of the kid.
 
The property protection excuse is absolute bullshit. He owns nothing there, he doesn't work there, it's in a different state, in a different town.
So you can go to a city and attack the police, destroy property, and assault the locals. Totally cool. But if you show up with intentions to defend the city from them, go directly to jail do not pass GO do not collect $200.
