I think this point is very valid.Obviously this statistical argument should be taken with a grain of salt. For one thing, it implies that every case that gets appealed has the same probability of being successful.
You have have an appeal like this, where the judge clearly didn't follow the rules governing the specific motion, and, at the very least, can point to said mistakes. It's up to the appellate panel, but at least you can raise the point.
Then you have appeals like Lacoste v. Keemstar, where the dude admitted he was a pedo, sued someone for calling him a pedo, got his ass kicked by anti-SLAPP, and is appealing that.
