It's criminal in the sense that she's alleging voter fraud, which is a crime.

Rudy's case is that the election wasn't conducted legally and allowed illegal votes to be counted. He doesn't need to prove voter fraud to win, only that those ballots were illegal.

Voter fraud did occur but you can't prove that before December 14th. You can, however, prove that hundreds of thousands of mail-in ballots were counted illegally due to a lack of Republican observers, no chain of custody, etc, and that other rules set by the legislature were not followed and that those should be thrown out. Actually proving voter fraud will take longer. That's the reason the cases were split from each other.

In all likelihood he got more white votes in 2020 than the last election.
A +5% support among blacks does not equal to 10 million extra votes.
