A federal judge has awarded just over $10 million toward the future care of a severely disabled child born because a nurse at a Seattle community clinic negligently gave the mother a flu shot instead of her quarterly birth-control injection.

U.S. District Judge Robert Lasnik awarded the child, identified in court documents by the initials “SLP,” a total of $7.5 million for the girl’s “extraordinary medical, educational and similar expenses” that will accrue throughout her life.

The judge last week awarded $1.5 million to the child’s mother, Yesenia Pacheco, and $1 million to the father, Luis Lemus, to “compensate for mental anguish and emotional stress” as a result of the unwanted pregnancy. The family received an additional $42,294 to compensate for two Medicaid liens, according to court documents.

“This has been a hard-fought battle” that lasted eight years while the government refused to take responsibility for the negligence of a nurse at a federally funded clinic, said Seattle attorneys Mike Maxwell and Steve Alvarez, who represented the family in what’s described in court documents as a “wrongful pregnancy … wrongful life” case. The lawsuit was filed in 2015, three years after SLP was born.

“Luis and Yesenia Pacheco are pleased that they’re closer to receiving the funds needed for their daughter’s extraordinary medical care and training,” they wrote in a joint statement that was sharply critical of the government’s refusal to accept responsibility at the outset.

“It was a long hard road for the family,” they said.



Emily Langlie, a spokesperson for the U.S. Attorney’s Office in Seattle, which defended the lawsuit, said some of the delays were necessary to ensure medical experts could accurately measure the extent of the child’s disabilities.

According to court documents and testimony in a two-day bench trial held before Lasnik in January, Pacheco — an El Salvadoran refugee who moved to the U.S. when she was 16 — had gone to a Neighborcare Health center in Seattle on Sept. 30, 2011, to receive an injection of Depo-Provera, a hormone used for birth control. Women using the treatment are supposed to receive an injection roughly every three months to prevent pregnancy. Pacheco, who already had two children with Lemus and was trying to avoid another pregnancy so she could help support her family, had made an appointment for the hormone treatment for that day, according to the pleadings.

However, a nurse at the clinic who had been administering walk-in flu shots all day apparently did not check Pacheco’s chart and gave Pacheco the flu vaccine instead of the birth-preventing hormone, the court found. Pacheco didn’t discover the mistake until she called to make her next appointment, more than two months later. By then, she was pregnant, the documents say.

“Ms. Pacheco had not planned or intended to become pregnant in the fall of 2011 and had taken affirmative steps to avoid an unwanted pregnancy,” wrote Lasnik in a March order finding the government liable for the unwanted pregnancy and “wrongful life” that resulted.

“Had she received a Depo-Provera injection on September 30, 2011, she would not have conceived. The unintended pregnancy and birth of S.L.P. were foreseeable consequences of [the nurse’s] error,” the judge wrote.

“The risk that a child will be born with a medical condition or disability is within the general field of danger that arises when a medical provider fails to use reasonable care in a procedure designed to prevent pregnancy,” Lasnik concluded.

The documents indicate that SLP is now 8 years old and in third grade at an Everett-area school. According to court documents, she suffers from a birth defect known as bilateral perisylvian polymicrogyria (PMG), which has resulted in cognitive delays, slowed speech and language skills, epilepsy, vision problems and other complications. She has an IQ of 70, according to the family’s attorneys. Maxwell said that she will live a normal life span, and will require some level of care and assistance for all of it.

Lasnik, in awarding the damages, has asked the parties to submit suggestions on how it should be distributed. The government is asking that some of it be placed in a “reversionary trust” that would ensure that, should SLP die or not need the funds, the money would go back to the government

Yeah I would understand not being able to abort in a red area where abortion is difficult to get/expensive, but I'm pretty sure Seattle has good abortion access. Not to mention they could have also put the kid up for adoption.

The nurse fucked up and I agree they should've been awarded something, but yeah it feels like the parents were just trying to win the spud lottery. Hopefully they don't take resentment and shit out on the kid :(

Reminds me of Gwen and Scott Hartley. On the one hand Gwen would insist that she loved her perfect sassy girls so much, on the other hand, both she and Scott would ridicule and torment Lola and Claire-as much one can actually torment anyone with almost no brain-on an almost daily basis.

Eva is sadder because she was born normal and must have some brain power left over. She's not a completely fried, born broken potato. Anyone with empathy would not mock her and try to be understanding and kind because she could basically be trapped in there now with normal or residual awareness but not be able to express it anymore and be suffering.
 
I don't know. She's got a look to her that reminds me of Terri Schaivo, and the autopsy proved that she was definitely a total vegetable. Is there any proof or signs that Eva is still in there?
You can't really judge on appearance. It was pretty embarrassing for Bill Frist when he looked at a video of Schiavo and claimed she was obviously totally still there. Well, it would have been if that dumb bastard had even a trace of capacity for shame. And he was an actual medical doctor, at least in name.

It's always fun when moms think they know more than doctors (or disabled people) because they read a bunch of shit from Google. Antivaxers are especially bad about that, though prolifers can be pretty bad with it too (so many prolifers know dick all about fetal development, how abortions are actually done, or really anything).

I disagree. The parents were behaving responsibly by using contraception; you could argue they were being more responsible than the average Jane by using contraception with a lower rate of user error than birth control pills. The clinic shouldn’t be able to opt out of responsibility because abortion is an option.

What if she had brought her child to the clinic for medicine, and the nurse administered the wrong medication and killed it? Should they not be liable for damages because she can just have another kid?

Of passing interest, on how radically attitudes and ideas have shifted in less than fifty years, regarding intellectually disabled children.

I’m reading a biography about Caroline Lamb (infamous lover of Lord Byron) While the subject of the book lived in the early 1800’s, the book was written and published in 1972.

Lamb had one son who by various accounts was epileptic and retarded. Some now believe he might have been severely autistic, but lived to be 30. Anyway, the British author only devotes two paragraphs in the book to the child. (One would think their only surviving child and the impact it had on their lives would merit more words, but nope.)

The body was healthy but the mind developed not at all. She had given birth to no more than a soulless lump of humanity. But she refused to face up to the possibility that the child was abnormal. She merely thought of him as perhaps a little backward.

The author didn’t hesitate to describe the child this way and this was in 1972. The attitudes during the era little George existed in were far harsher. Today he would get 15 years of schooling and he’s probably relatively bright compared to many of the miracles of this thread.

Saw something today that said of Americans making less than 40k a year, 40% think abortion should be mostly illegal and 30% think abortion should be totally illegal. What do we think about that? Do you think poor women are more likely to keep their taters, since it’s not like they have a real career that’s going to be derailed?

Y'see, you are dealing with the "sullen majority" of losers who are pissed someone out there thinks they're better than them and does the Unspeakable. The fact that coathanger abortions will rise and the rich will abort anyway doesn't bother them, because it doesn't enter their zone of petty malice. They make their lives tolerable by making others as miserable as themselves to not feel left out.

I think it's more that poor people tend to lack education and have more conservative religious beliefs, especially in the US.

It was pretty damning that they filmed over six hours of video but had less than five minutes of proof to work with. At any rate I'm not feeling too optimistic about Eva. If she's still even mostly in there, her life is absolute hell now, so to be honest if there's no hope of recovery it really isn't the better option anyways.

I kind of hate this overall trend of speculating or diagnosing long-dead people as autistic with little to no proof. I get that autism is the trendy developmental disability now (and even today it's less shameful to have an autistic child than just a run-of-the-mill retard), but most of the information isn't nearly detailed enough to make any assumptions beyond just retarded.
