If they hear arguments today, I would imagine they'd rush out a decision to avoid being called charlatans - a decision which is almost certainly going to be "that didn't prove fraud and you had enough time to investigate" barring anything last-minute that changes the whole game.You know I've been thinking about this. Your position is that Alito knows he can't rule after midnight on the 8th. Originally he was going to make both sides file their briefs by the 9th but then he thought it would be funnier to make them file them a day earlier so they'd have to spend all night working on them,
After that was he was going to say 'Thanks for getting the briefs in a day early but it's too late for me to rule.'
To be honest I almost want this to happen. The US loses troll in chief Trump but it gains troll in chief Alito, and you can't even get rid of him by ballot stuffing. If you try to pack the court he'd just tell you to work all night on your briefs and then come up with some bullshit reason to rule against you. The idea of him, ACB, Gorsuch and Thomas all laughing it up like this picture of Reagan and Bush Sr cheers me up no end
Here's a thought experiment. Suppose the Supreme Court had ruled on the 13th in 2000 and you thought that was illegal. Who would you appeal the case to? The Supremerer Court?
If the court in 2000 had made their decision after the harbor date, it's not necessarily illegal - I'd just see that as intentionally sandbagging it. Basically, you can't sue the Court because of judicial immunity; you'd have to take what they gave you and then attempt to disbar and replace the judges with due cause afterwards.
