I believe he made the response deadline intentionally so close and so late to the safe harbor deadline so that they could just let it sink, yes. Why would he originally set it on the 9th?

Why don't you put him on ignore? If he says something novel you'll see it anyway because someone will quote him. I've had him on ignore for ages and nothing anyone quoted him saying was worth reading. It'll some shit about challenging people to bets.

I'm not sure there is a 'final decision' in this process. If the SCOTUS kicks it to a contingent election we'll wait for that. If Biden wins I think it will unravel over a couple of years. If Trump wins there'll be AntiFa riots and an insurgency pushed by the media and probably crushed using the Insurgency Act.

All of these are a slow-boiling crisis, not a resolution of the situation. Oh yeah, and the economy is completely fucked due to the lockdown and out of control spending no matter who gets in.

And then there's the fact that if Trump gets back in he's got no control in the House and might not have control in the Senate. Biden would have the House but probably not the Senate, though the Georgia GOP seems to be doing everything it can to give him the Senate for reasons best known to themselves.

No matter who is POTUS they've got to deal with the fact that they've got no control of which states lockdown and which states do not and the media are going to push for lockdowns no matter what.

The more I think of it the risk is not some sort of uniparty dystopia it's a weak and divided government presiding over a depression worse than the 1930s. Any POTUS at this point is going to regarded as illegitimate by half the country.

Not that I find this to be any reliable source or definitive, but yes, the court does things like this - they hear a case, or leave open the mechanisms to hear a case, which they never have any intent of doing anything with. The closing paragraph argues that there is a line in scotus practice where these lawsuits are both heard but don't go anywhere by midnight.

Otherwise, what, he originally set the day for the 9th because he has alzheimer's? Why not make the deadline last friday, or even monday night?

Eh, I find the banter entertaining, and while I disagree with him most of the time, at least his stuff is more comprehensible than 311. Also, as a Trumptard, I don’t just want everyone agreeing with me. It’s boring that way too.

Common sense? Like putting the deadline for PA to respond after the mark where the court can't do anything about it, IE the 9th?

My point in that article is literally just to point out that there is a legal argument that the court lets cases fall into irrelevancy rather than directly remanding or ruling on them.
What other justification is there for Alito setting it on the 9th, and then at a time whereby the filing would not be heard until the next day?

I don't think it's that unlikely that he set it for December 9th, got irritated with this being interpreted as him making a political statement since it's after December 8th and therefore supposedly doesn't matter even though the state results are still contested, and updated it a day earlier to essentially say "no, that's not what I'm intending". Don't underestimate how frustrated a justice can get especially when people are claiming that they're taking a stance based on something innocuous- look at Gorsuch's statement after the recent ruling on church gatherings for instance.
 
If someone gets themselves permabanned over a bet or spergs so hard they leave the site FOREVER or chooses to be banned instead of earning one over this election/thread then I think this thread was incredibly successful and full flights of beer for all the lads left.

I think that either way we’ll probably have something akin to Bleeding Kansas. Tensions between cities and rural areas have gotten worse, and it has accelerated a lot this year due to lockdowns under Corona and the riots. Either potential president will be dealing with it. This election is the cherry on top of the tensions that have been mounting for years.

FBI has the rural areas and right under lock and key. Only real place for violence to go is leftwing-wards as bureaucrats immediately start supporting those groups the second they hear the SC is trying to hand Trump the election.

Mildly moot point though, because the SC at best might say PA is fucked but are not going to overturn the election.

If the electors and the votes are certified, then it is not contested. Any state which does not certify or is forced to revoke its certification is contested. This is what that language means.
And if there is a state which is contested, it then goes on to "govern in the counting of the electoral votes as provided in the Constitution, and as hereinafter regulated, so far as the ascertainment of the electors appointed by such State is concerned."

By midnight tonight, you need to compel enough states to contest their vote and revoke their certification to strip an absolute majority of electors from going for Biden. Good luck!
