It still seems utterly ridiculous that in a situation such as this, even if the defense wins, they are left with a ton of cash in the gutter after they have demonstrated that the suit was not justified (otherwise the defense wouldn't win after all).
That seems like a very fundamental, unaddressed flaw in a justice system as it should be obvious from the getgo that there is basically (almost) no way to recuperate from an ever-undeterred litigant suing pro se and in forma pauperis I would imagine. And I keep essentially reposting this with different phrasing, but it just boggles my mind that there is no failsafe to keep people from needlessly running up costs just to defend themselves.

In case this comes across the wrong way - no the case has not been dismissed at this point in time. I might as well treat it as such though because from reading all these (sometimes ridiculous) filings, I think most of us can agree that the probability of this not getting dismissed is 0 percent. Nil. Or in German: Null.

It's taking the ammo away from someone after they've shot a sufficient number of people in the foot, whereas what ought to be sought first and foremost is a way to cover the medical expenses for people with injured feet.

Essentially, a system that allows frivolous lawsuits to proceed on its dime should be willing to cover the expenses of the defending party as well, if the lawsuit turns out to be unjustified - either by literally covering the costs (not a great solution for the state, as we see in some parts of Medicaid) or by fx. introducing a certain quota for every defense lawyer to cover at a low, set rate if it is required, even in civil matters, rather than just having court appointed attorneys for criminal matters.
Otherwise, the court system essentially supports (civil) prosecution, but not defense.

I think a lot of the time the ifp status being abused over and over again for unjustified civil suits doesn't happen to the level that we're seeing it here, because most people aren't crazy/dumb enough to also proceed pro bono. We need to keep ifp filing around so that poor people aren't locked out of civil justice, but letting them file pro bono as well is a giant problem. The cases need to be vetted as meritorious by someone other than themselves.
We're seeing an extreme example of what can go wrong here, not the way the system is supposed to work, at least in theory.
Although I'm sure that if someone asked Melinda, she'd think that it's working perfectly. Paying legal fees is the only punishment any one she has sued has ever suffered. Note her outrage that Josh has gotten donations to help with his.

You've got to consider the fact that people like Mel are minority(not in race). Usually fear of punishment keeps people from (noticeably) abusing the court system. When you are both a retard, and extremely poor, that fails to apply.

That opens even more exploitation. Now both the plaintiff and the defendant know they wont be materially punished. It'd take a three-man conspiracy and the goverment suddently makes them millionaires (defendant hires a lawyer friend, file as many motions as he can, eventually wins because plaintiff was also filing bullshit, state pays fuck ton of grand to the lawyer, who shares the money with his fraudulent partners).

So, essentially, what US is doing with Medicare? Yes, that has been working very, very, very, very well. I do get where you are coming from. Yes, the court system is not perfect. Yes, it does have a lot of flaws. But, there is no easy fix. Fixing a relatively small problem and introducing many big ones might not be the best answer.
