If Vic gets past TCPA, there's yummy discovery, more people getting deposed, and suddenly they have to pay their own lawyers. Vic's financed by weebbux, but the moment that MoRon's (probably fictional) insurance gets wind that there's a chance that they intentionally torted someone, their coverage disappears faster than a jelly doughnut in front of Jamie Marchi.

We know from cases like Chris Hook's that insurance companies are stingy fucks, so they'll find any and every opportunity to kick MoRon to the curb.

Vic could lose if it ever gets to trial (the British diver guy lost his case against Elon Musk at trial, even if he passed the federal version of an anti-SLAPP), but getting past TCPA is a minor win for Vic and a pretty good win for Kiwis, because we will see utter salt and autism from KV. As I've mentioned a few times, a lot of KV (look at BT) have made the TCPA dismissal such a central part of their identity that even a partial reversal is going to throw them into an existential crisis.

So, sure, we can only hope, but it'll be fun as fuck.
I hope he does get past it, cause salt and I would like justice for the good guys. I still doubt that ron has insurance covering his lawsuit. I don't remember everything about the Musk trial but I think Musk having celebrity status was very beneficial for him. And with twitter, #metoo, and believeallwomen being more dominant than facts and evidence, I can only expect the worst and hope for the best.

I was touched on in page 892 of the lawsuit thread.

TLDR: Musk called the diver a pedo. Diver sued for defamation. Lawsuit passed the 12.b.6 motion to dismiss (which is basically a federal court's anti-SLAPP) and went to to trial, where the diver eventually lost.

The main difference between that case and Vic's is the defendants clearly meant what they said, whereas Musk was just shitposting like he always does. If you asked if Ron was just saying Vic figuratively assaults people, or Monica if Vic only hypothetically attacked her in the hotel room, or that Vic only notionally wrenched back Jamie's head, they would say fuck no, they are making statements of fact meant to be taken truthfully and seriously.

There was actually a trial, before a jury, and the jury apparently made the finding that he didn't intend it as an actual factual statement.




Since we know, and the court had found, that Musk actually did make these Tweets and presumably other people saw them, and the plaintiff submitted an affidavit, which was uncontroverted, that the statements were false, and there is no evidence he did any research whatsoever as to the truth or falsity of them, it looks like the jury's determination was based on 3.

I.e. did the people who actually read these Tweets believe, as a result, that Unsworth was actually a pedophile. Statements like this are defamatory per se but that does not mean you automatically win your case. It does generally mean you can defeat a motion to dismiss or for summary judgment unless the context is so clear that they weren't meant as factual statements that there is nothing to determine for a jury. It also doesn't mean the defendant can't win for some other reason, even with clearly defamatory statements. It just means the plaintiff is not required to show actual damages to defeat a dispositive pretrial motion, such as a SLAPP filing or a motion to dismiss or a motion for summary judgment.

So, in this case, Unsworth did get his trial. He just lost, presumably because they didn't feel he'd proven the audience actually even believed these statements to be factual in nature.

In this case, Unsworth presented his evidence, by affidavit, that the statements he was objecting to were in fact false and were clearly defamatory per se. And he got to go to trial.

Here's the court's ruling denying Musk's motion to dismiss:

It doesn't even discuss whether the statements are defamatory per se as the defense was that they were not intended as statements of fact but of opinion or heated rhetoric. I don't think the court discussed the issue because it so obvious that accusations of pedophilia, and particularly, of literally having a child bride, are defamatory per se if taken to be factual.


The judge didn't do anything wrong. He denied the motion to dismiss, as the complaint clearly set out a colorable claim. The defendant won in a jury trial. I note lead counsel for plaintiff was Lin Wood. That guy seems to have his fingers in a lot of pies and little good seems to happen with him around. I'm getting Avenatti vibes tbh.

There's a serious advantage to just being a complete absolute idiot who constantly posts complete bullshit. If you're ever sued for libel you just say I only did it for the lulz.

A thought occurred to me: I find it astounding that somehow Lemon Fuhrer J. Sean Lemoine did not get COVID.
His West Nile riddled ass must be bunkered down or he must have been one of the first ones in line to get a vaccine.
When did the vaccine first come out? I know Our Lord And Savior Biden has magically produced vaccine now that Orange Man is gone, but were they trialing it in 2020?

There's still more hope. I think the new strain is more virulent than 2020's, so maybe 2021 is the year China claims Lemwaaah.
