The FBI defines rape as "Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim."

This isn't necessarily a useful definition of the word and is mainly for the purpose of keeping statistics. After all, many states don't even have a crime called "rape" any more, but simply define various sorts of "sexual assault." Pretty much any rational definition of rape, though, would include some form of physical contact.

I'm going to ignore the inherit stupidity in making up genders for a moment and focus on something else: this person 100% has a gender and it is virgender. They are not genderless if they are virgender. They are virgender and thus have a gender.
