The parents of a 17-year-old girl who was raped on 24 October 2020 are to sue the state for "gross negligence". According to the parents' lawyer, Fabien Rajon, the girl's attacker was released prematurely from prison on 5 May 2020 for a reason linked to the health crisis.
"The responsibility of the judicial institution deserves to be debated, in our opinion. This is why we are bringing a case against the judiciary, specifically against the State, for gross negligence before the Paris judicial court," he said at a press conference on Tuesday 13 April.
In a statement issued after the press conference, the Lyon public prosecutor's office denied this version. "The decision of the Lyon JAP (judge for the application of sentences, editor's note) is in no way a judgment of automatic release resulting from the health crisis situation but a decision of placement under conditional release taken at the request of the convicted person and after a favourable opinion from the Lyon SPIP (prison integration and probation service, editor's note), the prison administration and the Lyon prosecutor's office", the prosecutor's office wrote. "The person concerned, who can be released on 20 November 2021, has been in the legal conditions for conditional release since 6 January 2020," it added.
A previous ultra-violent attack
The attack on the young girl took place on 24 October 2020, in La Tour-du-Pin, Isère. That day, Anne-Lise was invited by a friend: she found herself in a flat with several people, including her future attacker, whom she did not know. The man, of African origin, quickly showed himself to be threatening. "This individual, who is particularly impressive because of his physique, will force her to stay in the flat, will put her under his influence. He also drugged her, encouraged her to drink and then raped her," said Fabien Rajon. In the aftermath, the young girl filed a complaint with the gendarmerie along with her parents. According to them, a gendarme then told them that the individual in question had benefited from an "early Covid-19 release".
The attacker had six other convictions on his record. And he was serving a five-year prison sentence, one year of which was suspended, for acts of violence, sexual assault and arrest, kidnapping, confinement or arbitrary detention with release before the seventh day committed in a marital context. This sentence had been pronounced by the Bourgoin-Jallieu correctional court on 18 December 2018, says the Lyon public prosecutor's office. A few moments before raping Anne-Lise, the individual also mentioned this previous aggression, telling her that he had "already done it".
The parents of the young girl outraged
The early release of the individual outraged the victim's parents. "How can an individual with such a violent background be released? How many of them have committed similar acts while on release from Covid-19?" the girl's father said at the press conference. "We are wounded, deeply marked, tired and angry. We cannot remain silent about this crime," he continued. "Justice has released a dangerous individual and our daughter has suffered the consequences. Justice has not done its duty. This case is a real scandal," said the victim's mother.
Was it foreseeable that the individual would re-offend after his first sexual assault? The decision of the judge who allowed the individual to be released on parole on 5 May 2020 is being debated. The psychiatrist mentioned "a risk of recidivism qualified as average, which cannot be eliminated and a tendency of the prisoner to commit hetero-aggressive acts", recalls Fabien Rajon. For its part, the Lyon public prosecutor's office highlighted several elements noted by the sentence enforcement judge in his decision. According to the judge, "the person concerned seems to be aware of the seriousness of the facts and the damage caused to the victim" and "the psychological follow-up initiated in detention seems to be bearing fruit". "A promise of employment was sent to the detainee following a meeting with an employer during a leave of absence which went well," he also noted.
A Grenoble investigating magistrate has charged Anne-Lise's attacker with rape of a minor over the age of 15, and he has been remanded in custody.

The Controller General of Places of Deprivation of Liberty Adeline Hazan denounced the unpreparedness of the French public authorities in the face of the coronavirus epidemic and called on the government to go further by releasing 7,000 additional prisoners at the end of their sentences.
