Let's pretend for one moment that he does die before the election, just for the funsies. What happens then? Will the nomination revert to option number 2, aka Bernie Sanders? Or will his running mate automatically replace him just the way Vice-President is supposted to step in after the Big Man in the White House chokes on a piece of matzo? Does he even have a running mate yet?
 
lol, wut? The Supreme Court has no max number of justices, nine is just tradition. If Biden wants more, he can nominate whomever he likes and they can go through the process.

Arguably, Congress setting any number high or low through legislation is a breach of separation of powers. It may be up to Congress if any individual is confirmed, but it is not up to Congress how many Justices can or can’t be seated at any given time.
The Dems seem to see legislating anything no matter how unlikely it will pass gives them more legitimacy on their aims. They would probably EO more justices but know the political blowback would be awful.
Considering how... Everything Biden has done so far has seemingly backfired on him Looney Toons style, I'm going to guess 0 judges before midterms take all the gains away. The only thing he will have accomplished is pissing people off.
I hope Biden is happy getting to be a lame duck president for 2 to 4 years while his mind increasingly slips away.

I don't understand what this person is trying to say. Yes to most of it? Except the part where black people have a monopoly on "not being heard", which is undermined when they rightly point out that Trump and his supporters are being censored.

European-descended white people have been complaining about being silenced since before the nation's founding. It isn't a contest, we should all be working together and supporting protests and incursions at the source of the problem: Congress.

More January 6ths please!
 
The thing is, they don't even need to pass it for their plan to backfire. FDR tried to pull those shenanigans when parts of the New Deal got struck down, and even though he didn't succeed in packing the courts, the following elections drastically swung Congress back towards the Republican Party. They didn't claim a majority, but they were no longer the party-in-exile they had been since the Great Depression kicked off.

Right now, the Dems have the slimmest of majorities in the House, and an even split in the Senate. Assuming they don't get up to even more electoral fraud shenanigans, pulling shit like this could easily flip both chambers back to red. And that's before getting into any other potential failings that may play out over the next two years, the biggest being a botched coof response and a downturn in the economy. And let's not forget the radical left that keep running their mouths about how we can totally pass a ten trillion dollar bill or how we need to abolish the police and military. That shit's guaranteed to turn off a lot of people.
What this guy said. The Dems aren't going to be able to pack the court unless they find a way around the Senate somehow(good luck with that)and the only way they can avoid the political backlash from what they're trying to pull right now would be electoral fraud that absolutely dwarfs what we saw in 2020. I'm not optimistic about their chances in the mid-terms honestly, barring something like a sudden and strong economic upturn and even then they will still lose the house.

WASHINGTON — Congressional Democrats will introduce legislation Thursday to expand the Supreme Court from nine to 13 justices, joining progressive activists pushing to transform the court.
The move intensifies a high-stakes ideological fight over the future of the court after President Donald Trump and Republicans appointed three conservative justices in four years, including one who was confirmed days before the 2020 election.

The Democratic bill is led by Sen. Ed Markey of Massachusetts and Rep. Jerry Nadler of New York, the chair of the House Judiciary Committee. It is co-sponsored by Reps. Hank Johnson of Georgia and Mondaire Jones of New York.
The Supreme Court can be expanded by an act of Congress, but the legislation is highly unlikely to become law in the near future given Democrats' slim majorities, which include scores of lawmakers who are not on board with the idea. President Joe Biden has said he is "not a fan" of packing the court.
But it represents an undercurrent of progressive fury at Senate Minority Leader Mitch McConnell, R-Ky., for denying a vote in 2016 to President Barack Obama's pick to fill a vacancy, citing the approaching election, before confirming Trump nominee Amy Coney Barrett the week before the election last year.
The anger has taken hold within the Democratic Party, and the new push indicates that it has not dissipated in an era when the party controls the White House and both chambers of Congress.
The lawmakers, who intend to announce the introduction of the bill outside the Supreme Court building, will be joined by progressive activists Aaron Belkin, who leads Take Back the Court; Chris Kang, a co-founder and chief counsel of Demand Justice; and Meagan Hatcher-Mays of Indivisible, according to an advisory notice. All three groups advocate adding justices.
"This bill marks a new era where Democrats finally stop conceding the Supreme Court to Republicans," said Brian Fallon, a former Senate Democratic leadership aide and a co-founder of Demand Justice, who described the court as "broken and in need of reform."


"Our task now is to build a grassroots movement that puts pressure on every Democrat in Congress to support this legislation because it is the only way to restore balance to the court and protect our democracy," he said.
Last week, Biden announced the formation of a commission of liberals and conservatives to study the structure of the Supreme Court, including the number of justices and the length of their service.
The size of the Supreme Court, which has fluctuated since it was established in 1789, has remained at nine since 1869.
McConnell has strenuously warned Democrats not to add seats to the court, saying there is "nothing about the structure or operation of the judicial branch that requires 'study.'"
He quoted remarks from Justice Ruth Bader Ginsburg, who died in September, and liberal Justice Stephen Breyer, both of whom voiced skepticism about expanding the court.
"President Biden campaigned on a promise of lowering the temperature and uniting a divided nation," McConnell said in a statement last week. "If he really meant it, he would stop giving oxygen to a dangerous, antiquated idea and stand up to the partisans hawking it."

Republicans are cucked beyond belief, they would never dare to do something this bold. They will point out hypocrisy and do "gotchas" but they won't uproot the foundations of the system. Neither will I imagine that if they won an election would they either shrink or expand the SC to counter this, it would just be an "aw shucks, nevermind" moment for them. We are going to get to the point where your SC, the bastion and final arbiters of the constitution, are likely going to shit all over it. This is legitimately some 3rd world country levels of shit they are pulling.

They cannot get it through the senate. With the filibuster it would require 60 votes.

Even if they somehow gut the filibuster they still would not have the votes as there are quite a few democrats in purple states that will not vote yes.

Hell, Manchin has already stated he will vote "no" on stuff like this.

It is all posturing. Just like the 15 minimum wage vote that was destroyed in the senate.

But is it terrifying they would even put this bill forward tho? Yes. Are republicans cucks? Yes.

You're absolutely wrong. 9 is the current number of justices prescribed in the current Judiciary Act. To change that Congress would have to pass a new Judiciary Act to increase the number.
Imagine thinking that the words on paper actually mean anything.
Also they would only have to amend if courts cared about words on paper.
