If they're a danger to society then they should be held in remand, but that doesn't mean we should go out of our way to make that detention as miserable as possible and justify it with "jail's supposed to be a punishment".
Dave has was arrested back in 2017 for smoking weed outside a St. Louis on 4/20 to protest its criminality due to racism blah blah blah. Getting pulled over on the way to make some honey oil or edibles sounds the most plausible. Getting arrested on Drumpfed up weed charges would be the perfect soapbox for him to stand on and he'd do it in a heartbeat.
