As much as that is what I would do, they imposed an accelerated schedule on the procedure parts of getting the case filed. Every single party to the case blew off the schedule and acted like complete dicks. Nevertheless, it was submitted on time, at least with a generous interpretation of the rules.
Remember, an appeals court rarely has to interact with the dumb retards who were smacking each other around in a lower court. They just get a pile of paper, and then, when the giant pile of paper arrives, they get to decide things.
And this case presents a bunch of issues, not just the obvious one where Chupp should get smacked down, but issues where he might or might not have been right, like the SLAPP sanctions.
