Trashfire 07/08/2021: Gunt VS Matthew Vickers, Battle of Custody Begins

Faith is the wild card in this whole mess. Who knows? Maybe she is now chafing under her parents' protection, and she just wants to be out again. Did she lead Ethan to think that she wants to be a grown-up now and raise her child without her parents interference?
There is not a damn thing that the Vickers can do if Faith decides to take her child and go live in the crack shack, unless they are willing to have her declared incompetent and then they are turning the welfare of Zander over to the state to determine, not to mention totally alienating their daughter.
I will be keeping a close eye on Faith from here on out, and my guess is that she has been giving Ethan some mixed signals...

Probably only Gramps and Gram on paper. Practically, it covers setting foot or coming near their property where fai fai lives, probably making public statements about Gramps and Gram, and probably calling or connecting to devices Gramps and Gram own or pay for which most likely covers any device the Memphis Ten uses

I'm not sure that Vickers will ultimately succeed in getting a judgment because he engages back with the gunt in white trash dick measuring pretty consistently, and a lot of times you can use that as evidence that the contact was mutual or invited. But it will cost Ralph a bunch of time and money to deal with. Also, we have the same problem that we had with the revenge porn case, which is that Faith is a horrible witness and incredibly impeachable.

All this shit is probably just a gambit by Big Chief Vickers to depleat the meagre white trash warchest of the Ralphamale tribe by hiring many braves to press Ralph on every front. Then, Ralph, sign these adoption papers and we can forget about the nineteen lawsuits between us and that child support.

Big volume in precious metals right now, not a bad time to be a coin merchant...

The featured entry for this thread on the front page has a link to a screenshot of the court case. Based on the way California restraining orders work, Ralph technically already has a restraining order in place. What Vickers would qualify for is called a Civil Harassment restraining order. The Restraining Order Process​

When someone asks for a civil harassment restraining order in court, they have to file court forms telling the judge what orders they want and why. What happens after that varies a little from court to court, but the general steps in the court case are:

1. The person wanting protection files court forms asking for the civil harassment restraining order.

2. The judge will decide whether or not to make the order by the next business day. Sometimes the judge decides sooner. Then, the clerk will set a date for a hearing.

3. If the judge grants (gives) the orders requested, he or she will first make “temporary” orders that only last until your court date. The court date will be on the paperwork. These temporary orders can include issues like:
  • Ordering the restrained person to have no contact (including no phone calls or e-mails) with the protected person (and other protected people); or
  • Ordering the restrained person to stay away from the protected person (and other protected people).

Given that a hearing has been granted, this implies that a judge has already reviewed the evidence and determined Ralph is enough of a threat to warrant a restraining order. This puts Gunt at a pretty big disadvantage. He now has 4 days, 2 of which are non-court days, to find an attorney, give the attorney enough info to counter whatever evidence Vickers has submitted (which is unknown at this time) and appear in court.

Interestingly, CA restraining orders are much broader than I originally thought. From that same page:

What Can a Restraining Order Do?​

A restraining order is a court order. It can order the restrained person to:
  • Not contact you or any member of your household;
  • Not go near you, your children, or others who live with you, no matter where you go;
  • Stay away from your work, your school, or your children’s school; or
  • Not have a gun.

Not only would the order apply to Vickers home and business, since those are his property, but it also becomes a no contact order for Faith and Xander. Ralph wouldn't legally be able to see his kid even if he and Faith met independently away from Vickers properties.

If Ralph really wanted to insult Vickers he should remind him he did such a shitty job raising a daughter she ended up fucking Ralph.
