Surely if there is suspicion that he has raped his mother he should have been held at a police station for questioning.

You can't put somebody in jail just for being weird and having rumors swirling around about you. I'm not a lawyer but I think the longest they could legally hold him is like 3 days anyway, barring any further evidence. Right now all they have to work on is random ass shit on the internet.

My guess is after chris was kicked out of the house Barb was given a rape kit at the hospital and they're waiting for the results on that. Assuming they ever get them. I believe Virginia recently said it eliminated it's backlog of untested rape kits but who the fuck knows, a nationwide problem is that local jurisdictions have thousands of these things sitting around that nobody bothers to process. Other then that I don't know. I doubt they left Barb by herself. I'm guessing the poor woman is getting questioned by more then a few cops right now. As for Chris there's not really much they can do with him until they have something more tangible.

Yup, the protective order is basically to buy time and keep the victim safe while the process works its way through. I believe the order lasts until Aug 5 right? We'll know if the jailhouse saga starts soon.

The police did not witness the crime. Not that they have to, obviously, but in domestic cases it makes things easier. Think about on the show Cops when a husband and wife are fighting and the police are called. The cops show up and the spouses are on the front porch. The cops separate the two and talk to them. If there is physical evidence of a fight, one of the spouses has marks on their body, then they typically arrest the other spouse. Or if they see one of the spouses hit the other one then they make an arrest.

In this situation, the police just received calls from people about Chris saying he was having sex with his mom. They didn't have probable cause for an arrest. So the simplest and quickest thing they could do was put an order of protection against Chris. This ensures Chris is separated from his mother while the police and medical professionals examine Barb about the situation and for signs of sexual activity.

Based on their investigation with Barb, if they have probable cause, they can get a search warrant for the home and/or an arrest warrant for Chris. The order of protection ensures Chris won't be at the home to interfere with evidence and the investigation or further harm his mom.

They probably don't care where Chris is or what he is doing at this point as long as he's not with Barb or in their home. I'm sure the police have already spoken with him about the situation somewhat when they gave him the order of protection. They might not feel the need to bring him in for questioning just yet. Plus, I'm sure they're familiar enough with Chris by now to know he won't go far and where he's most likely to be if they do want to bring him in.

One thing I feel I need to bring to everyone's attention is this: just like having sex with Barb, there are hints that Chris isn't opposed to pedophilia or exposing minors to pornographic imagery in his works.
