My understanding is that in criminal cases the defence chooses if there's a jury or the bench. I think in Chris's case it's better to go with the judge because a jury of his peers is going to be much harder on him, because of the severity of the crime. It's incest and most likely rape, they'll probably try to charge him for other stuff too. I could see it being the other way though, where a jury may be more easy to get sympathy out of.
